Opening the card downloaded the malware on to the recipient's computer and recorded keystrokes and messages.

The agency has offered a $50,000 reward for information leading to his arrest."

Don't you think that the issue is the illegal interception of electronic communications, not that those purchasing the software from him suspected their spouses of cheating.

That could come in very handy for something criminal like stealing credit card information, which I imagine it would be used more for than catching cheaters.

According to the article, Both Carlos and the 1,000 customers who purchased his "catch a cheating lover" software were charged with illegal interception of electronic communications.
Suspicion of cheating was used as the hook to bait 1,000 customers that were also charged.
