Prosecutors in Norway are saying that the psychopath who shot all those kids was.... A psychopath. Insane. Not fit for prison.

OSLO—Confessed mass killer Anders Behring Breivik was insane when he killed 77 people in a bomb and shooting rampage in Norway, and should be sent to a psychiatric ward instead of prison, prosecutors said Tuesday.

A psychiatric evaluation ordered by an Oslo court found that Breivik was “psychotic” during the July 22 attacks — the country's worst peacetime massacre — which means he's not mentally fit to be sentenced to prison, prosecutors told reporters.

The conclusions, which will be reviewed by a panel of forensic psychiatrists, contrasted with comments made by the head of that board after the attacks. Dr. Tarjei Rygnestad at the time told who told The Associated Press that it was unlikely that Breivik would be declared legally insane because the attacks were so carefully planned and executed.

“The conclusions of the forensic experts is that Anders Behring Breivik was insane,” prosecutor Svein Holden said, adding Breivik was in a state of psychosis during the attacks.

In their report, the experts describe a man “who finds himself in his own delusional universe, where all his thoughts and acts are governed by these delusions,” Holden said. “They conclude that Anders Behring Breivik during a long period of time has developed the mental disorder of paranoid schizophrenia, which has changed him and made him into the person he is today.”

I think this counts as a "surprise" which is why I posted it. The assumption until now was that he was going to stand trial. Now it looks like he's headed for the looney bin.

They have their own legal system with its own definition of criminal insanity, but to me this sounds like "Guilty but Mentally Ill" more than incapable of distinguishing right from wrong.

The final conclusion will only affect sentencing and should have no impact on the criminal trial to determine his guilt, scheduled to start on April 16, 2012 and to last about 10 weeks.
If he is declared criminally insane and sentenced to closed psychiatric care, a judge will review his sentence every three years.
If he recovers from his illness, he could theoretically be transferred to a prison if he were considered a threat to society. He could also be released if the opposite scenario were to present itself.
His release is however considered a very unlikely scenario, and several lawyers of survivors and family members of the victims have said they are confident he will remain locked up for the rest of his life.
He could theoretically be out in three years! Yes highly unlikely but....

One thing I disagree with from that article:

The two experts who conducted 13 interviews over 36 hours with the right-wing extremist described in their 243-page report a person who had "grandiose illusions whereby he believes he is to determine who is to live and who is to die," Holden said.
Really? It's an illusion that 77 people are dead? It does not seem to be an illusion to me. He did decide who is to live and who is to die. That's the crime.

Well Fuji, that explains why I though the Court had ruled him sane.
