This thrtead is about informing a friend of mine about what he can expect to receive from a 2nd DUI charege. (First one 4 years ago). I am not condoning his actions in any way - just need some info.
He is definitely going to receive some jail time. That is a given.
From what I could find on the internet, it will probably be 30 days oin Jail. Do you have to serve the entire 30 days? Someone told me you get credits for weekends etc.
Are you allowed to use a cell phone sometime during the day?
Do you get smoke breaks?
Can you take books for reading?
Any other info would be appreciated.

I suggest he asks his lawyer, he probably knows a thing or two about those sorts of things. He has a lawyer, right?

I don't know a lot about DUI's, having never known anyone who got one, but I believe you are correct that the most likely sentence is 30 days in jail. You're right though; that doesn't mean he will serve out the entire 30 days. It'll probably depend on the circumstances of his case. Was he merely pulled over and charged? Was he in a collision? Was someone hurt? How much over the limit was he?

he can get 30 days intermittent i.e. weekends which is good b/c you go in on Friday night, out on Monday morning and it's counted as 4 days

PS - if he is not getting a lawyer he is an idiot
