Have You Made Out A Will? Given that we are in a pandemic and virtual wills are legal now in Ontario, have you or will you make out a will?

Yes I have a will . Be stupid not to but I need to make a few changes which I will do soon . I even bought my own burial plot back in 1995 . Haven't used it yet . LOL

Paid $1700 for the double plot . If were to sell it back to the cemetery today I would only get the $1700 that I paid for it even though they are much more expensive today .

I bought the plot right next to my parents plot . Well all of us did . This way we will be together pretty well in the same area . LOL Didn't want to have all of us spread out in the cemetery . At least when I visit my parents I know where my last resting spot will be .

Does it bother me to see the spot . No it doesn't . After all we all will die at some time . That's life .

I had a will drawn up 20 years ago. By a lawyer.

I've had relatives who died without a will and have seen the shit show that comes out of that. Relations, friends, acquaintances all come out of the woodwork all thinking they are entitled to a slice of the pie.

Hell, even when there is a will, I've seen people show up trying to stake a claim. Strange things happen when a person dies. I had an uncle who would been right in there like a hawk when someone in the family died looking to take possessions (cars, home furnishings, camera equipment, cash, you name it) even though he was not in the immediate family. It was nuts I will tell you. He wasn't the only one either.

GTA & Thereabouts...
Had our Wills done up by our lawyer as soon as we had kids. Don’t have our funeral arrangements arranged though...

Had a new Will drawn up a couple of weeks after my divorce. Divorce cuts your ex out of your prior Will entirely, so I had to draw up a new Will to keep her in it, as there are only her and the kids that I want my stuff to go to. This is because our children are too young to be able to handle what I want them to eventually have, so I need my ex as the intermediate beneficiary.

That said, as my RRSP can no longer roll over to my ex-spouse's RRSP tax-free, I made my children the beneficiaries of my RRSP instead of my ex.

I have a will but have not made any funeral arrangements. I should. I am single with no dependents so if I don't do it nobody will.

I should, what is the best, most cost effective route. The process scares me to be honest, people having a lot to gain from your death

If your will is very simple try Axess Law or Jane Harvey Lawyers. In my experience Jane is more flexible with slight complexities.

Likely cost from them 400 or so all in for simple Will plus Powers Of Attorney for both Property and Personal Care, which are both good things to have, as they appoint someone to take care of things and carry out your medical care wishes if you cannot.

Both firms easily found on Google and have multiple locations in the GTA.

Had all that done several years ago. Will, Powers of Attorney, funeral arrangements, estate kit, etc. Hopefully none of them need to be used anytime soon.

Nice, Good job. Also don't forget medical directives and beneficiaries on Investments and Insurance. Plus doing so to save taxes and bypass probate.

Actually you can do a will on line for free but it depends on if more than one person gets your assets etc. But more complex your asssets sure.

And technically you don't need witness really only necessary if you have more than one will (in the past) or think it might be contested.

Courts require the best evidence possible. That will mean that you must show your attempts to locate witnesses. The best evidence available would be from the original witnesses. They could confirm how and when the will was signed. You must satisfy the court that you made reasonable inquiries but cannot locate the witnesses. Secondary sources can then be considered.

Get some firends you trust to witness over zoom or some such. Include the video record with the will. Courts usually uphold wills.
Redo will after quarantine. Wacker the will the more witnesses are necessary - ie give all your money to you fav sp rather than you brother.

Same here for me but that was 10 years ago. Now my kids are 20 and I think its time to review and do a new one.

That is why I needed to update mine. Crazy how old they get so fast.

We also did POAs at the same time. Just makes me feel better knowing I have all that in order.
