way out in left field
I usually agree with JJ but this time she was OUT TO LUNCH.

According to her, if someone uses your car, and dents it, they're not responsible? Or if they come over and knock over a vase? SOrry, a person is responsible for their actions....

BTW: toilets DON'T wear out. Seals make leak, flapper valve may stick, but a porcelain toilet if NOT misused, will last for 100 yrs or more.....

Heaven, definately Heaven
Judge Judy pays for the defendents penalties. It's a terrible show and Judy should be removed from television. $90 million screaming at $15,000 a year "contestants".

This isnt a good example.... a car isnt normally used to be dented. A better one would be a friend uses your car (properly) and the timing belt breaks...its within the normal use of the car and he wouldn't be responsible.

JJ was trying to find out if she was "negligent" with the toilet and the Plaintiff couldnt prove anything....She asked the defendant.. did you hit it or misuse it? NO....Plaintiffs got no case.

No a toilet doesnt just "wear out" but like anything else...they can break or go wrong or be defective from the start....never say never

I agree with JJ

No, that's not what JJ said at all. The woman didn't break the toilet on purpose or recklessness, she used it in a normal fashion. There's no evidence that it wasn't broken due to wear and tear. If I go to use the washroom's air dry blower at a restaurant and it breaks, am I responsible? Not unless I misused it. Things break all the time.

But you gotta love the ending, JJ is incredibly witty.

Exactly, Mongrelu4u. Your analogy is more what she meant.
