couldn't they have seized the tissue for DNA testing or some such?

I don't know, just askin' ... anybody know how these police units operate?

maybe DNA testing was too expensive at the time? Or it wouldn't show anything they could use? Or just too much hassle, and they only want the easy kills / low hanging fruit?

DNA, this was 15 years ago.

Think how much a DNA test cost during that time and this was a supposed Rub& Tug bust. The higher ups would have laughed themselves silly.

That tissue could've belonged to someone else, and could they really force the john to give a DNA sample even if they wanted to for the purpose of proving that the establishment operated as a bawdy house? One cum-filled tissue, if it indeed was exactly that, doesn't prove that the establishment is habitually and frequently used as a bawdy house. Basically, impractical to go through such lengths.

I don't believe the PMO authorized this OBVIOUS smear but it's quite possible that it's other conservatives, or someone who sold that info or divulged it if they were a foe of Layton.

The tissue could also have been the MPA wiping the massage oil off her hands. Assuming he really was there for a legitimate massage I would think there's still oil involved and that the MPA will still clean up her hands afterwards.

Pretend your a cop... do you really want to "seize" that tissue :)

But yes, DNA would have been far too expensive then, and would be now, to justify the expense for such an offence, Especially the hassle of dealing with the Publicity of arresting a city councillor.

It is just simply...Jack got caught in a bad place.....the police let him go.


Sure....he can NOW SAY that he was never charged...never 'in trouble'

The truth is...He was let go.!!!

Never mind the cost of DNA testing, it is not illegal to ejaculate.

Cops have to collect actual, testable evidence that a crime defined in the Criminal Code has taken place. It is NOT a crime to have sex, or to pay to have sex.

Which they knew, even if many TERBians (who certainly should) still don't.

Evidence for that knowledge: It wasn't worth their bothering to find out if the wet Kleenex was semen or snot. Nothing criminal proven either way.

Him being in the 'Bawdy House' already made the case out!!

But Jack was cautioned at the scene and discretion of the Police took over. He was released.

I think it important to note...the Policeman actually entered Jacks name in his notebook. He probably thought that this could go sideways so he had to at least make SOME notes. Perhaps a Sergantt authorized the 'caution'...but the zealous police officer ensured his butt was covered by making a note!!
