A female freind who is here on a visit, and i took her to The Beach, or The Beaches, and she is bit of an exhibitionist so she asked me if we can come to this beach with our towels, mats, picnic basket, and all necessary items, and she wants to have a nice sun tan, and was asking me if she can go topless on The Beach, i told her i am not aware of such a rule, as i hardly can see anyone roaming topless on our toronto's Queen Street East The Beach, but there were girls who were sun tanning and their bras were un-hooked and when they used to get up some were showing their tits and some used to cover with their towels warpped around them. But the problem is my female friend wants to take a stroll on The Beach topless, she told me she does this often during summer months back home. As i do not want her to be in any kind of legal trouble with our LE's for breaking any law, i am just asking a simple question is Topless Allowed on The Beach, the law would not jump and create a huge hue and cry seeing her topless? and is it safe for her to roam with me topless with her panty on ! or is there any other Beach area in our region where i can take her to be topless and feel the Natural Sun Heat of Toronto:)

Totally legal...back in 2001 when the law was passed to not discriminate against woman for going topless, I remember going to lunch downtown and saw this hot chick walking down on Yonge street topless...this is one damn law that they got right :)

Take note, you might get a fine for saying "Beaches" instead of "The Beach". I hope someone has the balls to challenge this in court.

Topless is okay anywhere in Toronto. There is something in the court ruling which prohibits being sexually explicit...not sure what that means. Probably fondling breasts in a provocative way would get a person arrested. But topless is perfectly legal.

Perfectly legal.But it does make things very awkward for a family with children trying to enjoy their day.And they would be the majority.

In past years I have seen a couple of topless babes on the beach. Usually during the weekdays and often a group of girls. Seemingly European and often older than the giggly teenagers.

I have sometimes seen some topless hotties flying solo. In all cases the women weren't trying to draw attention or behaving like Ho's.

Kids are usually by the shoreline while the topless babes are further in on the dry sand.

Kids really aren't perverted like adults and though they may ask a question, the parent just has to answer it in a proper manner.

It is legal for women to be topless anywhere in Ontario that men can be, including private property such as Wonderland, and even walking down Yonge street. It appears that it is almost legal to be nude in Ontario, there is a law on the books that prevents it, but it would likely not stand up to a "harm" based Supreme Court challenge. There are nude people on Yonge street for Pride and World Nude Bike Ride, and the police do not challenge them. They recently changed the law in Ontario, to require cabinet permission for anyone to be charged with public nudity.

There are exceptions in the topless law, stating that it can not be for commercial or sexual purposes, I think.

I have frequently observed a police presence at Hanlans Point nude beach, but they are laid back, if you are simply nude, they have no reason to bother you. They often drive around on ATVs.

Granted I'm not a member of the Bar but I somehow doubt that. I would make a logical guess that Wonderland (like many businesse)s have it as a part of their policy that shirts are required by all so it is not gender discrimination.

Correct. I would expect Wonderland to simply have a blanket "must wear shirt" policy.

Yes, but not in Splashworks, the waterpark. Men can wear their swimsuits (only) there, so women have a human right to be topless there too. As you say, if a business has a shirts-required policy, women have to follow it too.

As everyone has mentioned, going woman topless in a public place is legal in most respects. The case in question, R. v Jacob, is whether being topless, in and of itself is an indecent act under the Criminal Code. The court ruled that the act of simply going topless is fine under the community standard of tolerance test. Just because some people were offended by Ms Jacob's choice of clothing (or lack of clothing) it didn't mean that she exceeded that test.

However, if your friend decides to intentionally insult or offend by fondling her boobs and licking them, I suggest she do it privately, at my house when my wife is out. You can come over and watch but bring beer. :)
