Leaving for a new job

I am starting a new job on July 9th, I will be giving my current employer my 2 weeks notice on Monday, does my current employer have to pay me for my vacation days that I have left or give me severance pay if they want me to leave earlier then the 2 weeks, I'm sure they will, Thanks

For sure the vacation days you accrued...not sure about the severance since you are leaving by choice rather than being let go or fired.

realthing is correct - to clarify if you are asking whether they have to pay you for the full two week notice period in the event they send you home earlier then the answer is yes (I have done this a few times) - all accrued vacation pay is paid out at your current rate of salary (I have even received holiday pay carried over from previous years)

Not exactly. Assuming you have a standard job for salary etc you have two weeks per year (may change to three weeks soon) as a legislated minimum. You only get the pro rata or accrued share of that minimum vacation paid out on a resignation. Not other vacation that you might have had beyond the statutory minimum. As for severance, you get none except that if you give two weeks notice and employer refuses this notice and asks you to leave immediately, then employer still must pay you for those two weeks.

You have to be paid 4 % of your pay which usually works out to 2 weeks

Severance is paid when you are let go with no notice.

Happened to me I was with a company for 14 years they thought they were going to give me 6 weeks pay.

I called them out and checked with a lawyer.

The law is a weeks pay for every year after 5 years.

If it goes to court some judges have given 2 to 4 weeks per year

I got almost a third of my annual salary.

This is why if a company gives you more than two weeks a year, you never want to carry over more than two weeks if you don't use all your vacation time. Some companies in good faith, will still pay it out, others will not. Don't take the chance. If your getting 4 weeks a year, make sure you use at least two weeks.
