Nasty collection agencys

Wondering if there is anything i can do and what my rights are as far as collection agencys i have 1 in particular who leaves the nastiest mssgs or speaks to me like im sort of kid when ive tried to talk to him over the phone and who is constantly leaving threatening mssgs on my machine ive tried being friendly offered a payment plan and all i get is the bad cop routine from this guy when ive spoken to him live or nasty voicemails when he leaves mssgs do i have any rights at all and do i have to put up with this.

You should try and deal with the owner of the collection agency first, the complaint process requires you to address it with the owner of the agency first. If no luck the Ministry will accept your complaint and the calls/letters should stop. They can still sue you if the amount warrants legal action but the calls should stop.

Although most bill collectors are hardworking people trying to pay their bills for their families, the slugs that break or bend the rules should be dealt with by the governing body. If the owner is a respectable business man he will deal with the collector and no need to go further than that.

FYI In small claims court It just costs $75.00 to sue someone, $30-$50 to serve, setting a trial date costs $100.00 and signing judgment $35.00. Seizing property costs $100.00.

In higher courts you are luck if you get 50% of your legal fees so if you have a $14k claim and spend $10k on your lawyer it would have been more prudent to abandon $4k and sue in small claims court. Most fair and responsible lawyers will tell you that. The only exception is when you want to muscle someone by suing in the higher court so that he has to hire a lawyer, could make tactical sense then if you know they will not spend the money on a lawyer to defend themselves.

Send a registered letter to collection agency: tell the collection agency that their telephone calls are harassing in nature and any further communication should be in writing. Legally they have to stop calling you. Been there done that and this works.

Not exactly true

That is not in the Collection Agencies Act but it does say that collectors cannot make so many calls that it would constutute harassment... It does not say anywhere in the Act that if you send a letter they have to stop calling you...it may work anyways because no agency wants complaints but there is no legal requirement to stop calling you.
