Patient bore his child after trysts in his office

Jun 12, 2009 04:30 AM

Staff Reporter

One of Ontario's most prominent psychiatrists yesterday admitted to fathering a child with one of his patients and committing sex acts with her in his office for two years.

Samuel Malcolmson, 71, former chief psychiatrist and clinical director at the Queen Street Mental Health Centre, pleaded through his lawyer "no contest" to allegations of sexual abuse of a patient, and to disgraceful, dishonourable and unprofessional conduct.

Malcolmson did not attend the hearing before a disciplinary committee of the Ontario College of Physicians, which revoked his licence. He resigned his practice two weeks ago.

In a letter he wrote to the Star in 1992, Malcolmson expressed how seriously he took sexual offences.

"A sexual relationship in all its forms between a psychiatrist and his/her patient is a grave violation of the doctor-patient relation and an abuse on the part of the psychiatrist," he wrote in the letter to the editor as president of the Ontario Psychiatric Association.
[I hate hypocrites]

The Samuel Malcolmson Lecture Theatre stands in his honour as part of the Centre for Addiction and Mental Health, which replaced the Queen Street Mental Health Centre the year he left in 1998.

In 2000, says an agreed statement of facts, Malcolmson was running a private downtown practice when a 34-year-old woman was referred to him for a psychiatric assessment.

In July 2001, the woman became a regular patient. Soon she and the married psychiatrist were engaging in a variety of sex acts in his office and on trips he took around the province to other clinics.

In February 2003, she became pregnant with his child. That July the woman ceased to be his patient; the baby was born in November.

And the affair continued, the woman said outside the hearing.

"We were together five years," said the former patient, who cannot be named because of a publication ban on her and the child's identity.

"After the baby was born, (Malcolmson) asked me to get sterilized," she said. "He said I was jeopardizing his career. I had it done at St. Michael's (Hospital) for him. His wife knew I was pregnant – he told her," she said of one period in 2003.

An especially rocky period followed, she said. Two weeks after she underwent sterilization he dumped her, she said.

The former patient sat composed in the front row throughout the two-hour hearing but did not address the five-member panel. Next to her, when not with a sitter in another room, the child sat drawing pictures with a notepad and pencil.

If he wants to play doctor with a patient in his office, well, if she is willing I don't care. What bugs me is the hypocritical part where he says people who do that are bad, then does it himself.

Man, there is so much at play here isn't there.

Doctor / patient sex

long term affair

married man

he's 72, she's late 30's.

child

steriization

The human condition can truly be a dark place sometimes and this guy is the poster boy for that.

At 72 though, taking his license away is really kind of a moot point. The guy was probably ready to retire and has enough money saved to cover his ass anyway.

Sounds like a case of hell hath no fury like a woman scorned. She's going to fix him for dumping her ass. I guess it goes to show you that even a guy like that who has studied human behaviour for 50 fucking years STILL doesn't understand women.

As indicated in the Toronto Sun article she didn't report him. Despite what happened, his patient wasn't the one who launched the complaint with the college -- instead, it was done by the CAS and another psychiatrist after they learned of Malcolmson's seriously crossed boundaries. As the Children's Aid Society and his colleague reported him once they caught wind of his conduct, do you care to rethink your comments now?

Shame on this Dr. Malcolmson for taking advantage of a vulnerable woman like that:( . This IMHO makes the whole Psychiatric profession look bad.

Psychiatrists treat the most vulnerable people in our society. For a shrink too lose his license for sexual misconduct is beyond comprehension. These shrinks employ such things as transference on their patients.

In other words the positions of power are way out of whack. The shrink has all the power and credibility and can basically do what he wants to the patient. I hope the woman in question files a civil suit against this shrink!

Far as I'm concerned this goes beyond civil law and into the realm of a criminal act. This POS should be looking as jail time for sexual exploitation. What a complete fucking dirtbag.

That FACT wasn't in the original post or link.

Therefore, I had no way of knowing that.

Happy?

I'm surprised that the Criminal Code doesn't include this. In many jurisdictions patients being treated for emotional or mental disorders are legaly incapable of giving consent to any relationship involving a metal health provider.

That should be the case here. He's in a position of power, trust and authority and he took advantage to get his rocks off. Asking her to get sterilized? Are you f*&king kidding me? Poor lady, poor kid, this guy is a dirt bag and whatever problems she had that led her to him are probably still out there.

The world is full of pieces of sh#t like this, someone needs to flush.

Where's the backfire? She'd be the one going to jail, not the patient!

Still a bad idea, while you are being treated.

In a number of professions this is an issue - if not always of criminal law - certainly of professional licensure. The bottom line is that if you agree you want to date, one of you can't be the client of the other or the supervisor of the other.

You also notice how the college of physicians and surgeons doesn't rush into anything!

This shrink had an extra 4-8 years to earn money before his license was revoked:confused: ? Based on the fact that the sexual misconduct started in 2001 and she became pregnant with his kid in 2003.

Never mind earning money, how about exploiting additional patients?

To leap all over an exploited female who has been victimized by her shrink might have been out of line, no? To immediately imagine that hell hath no fury like a woman scorned might have been out of line, no? The guy had it coming. It's a shame the woman didn't have the guts or sense to report him. Or his wife who knew what was going on. Nothing to do with scorn but more to do with just desserts.

It didn't get reported immediately.

I agree his getting her to get sterilized is low, and dumping her right afterward makes him a skunk.

However, I am not opposed to doctors dating patients. If she was looking for love it makes no difference to me if she got it from the pool boy or her shrink. If two consenting adults want to fool around...well, everybody is seeing a shrink these days...she is not incapabale of giving consent just because she sees a shrink.

He is a skunk for her behaviour with this woman, but he is a hypocrite for publically denouncing doctors who sleep with patients and then doing it himself.
