yup just got myself pulled over for speeding.

apparently in hamilton unless its posted it 50 kph, and I thought it was 60 KPH.

my question is how are people supposed to know this when the speed is not posted and there are no signs indicating the designated limit when you enter the city limits?

I was recorded as driving 72 in a 50, but since there is no posted limit I shouldnt be responsible.

I tried to reason with the officer(he dropped it to 10km speeding) but was not able to get him to tear it up.

given the circumstances and if I go to court can I get this thrown out?

or perhaps he wont show to court?

thoughts?

Obey the maximum speed limit posted on signs along our roads and highways, but always drive at a speed that will let you stop safely. As a general rule, drive at the same speed as traffic around you without going over the speed limit.

In cities, towns, villages and built-up areas where there are no posted speed limit signs, the maximum speed is 50 km/h. Elsewhere the maximum speed limit is 80 km/h.

Sorry to hear about your bad luck, but if you've been driving for a while it should be drilled into your head about unposted speed limits being 50 kph all over the province's built up areas.

If this is a PSA, thanks for the reminder. If this is a whine, suck it up and pay the fine.

Yes and I believe on various main throughfares heading into Hamilton they have the max 50Km/hr unless signed other wises signs up along with the no parking between 2am and 6am on city streets or something.

Every moron (or so I thought) and his brother knows that the unposted speed limit is 50 kph.

Others have put it more bluntly already :) but ignorance of the law is not an excuse. There are plenty of signs around Hamilton and other cities that state speed limit is 50 unless otherwise signed. I've never seen one that says any other speed than that.

So using that as an excuse will almost certainly not work for you.

actually Ive been driving for 20 years now with a spotless accident record and the occassion speeding infraction(me thinks 5 ).

I was unaware of 50 kph unposted limit, and have not noticed any of the main signs on major hamilton access points.

I wasnt looking for criticism just checking in if I have a leg to stand on to argue in court. Id rather not have my insurance go up for a speeding ticket if I can avoid it.

So you're saying that you admit to speeding, but not as much as the cop said you were... but that the cop dropped the ticket down to the amount that you thought you were speeding, rather than the amount that were actually speeding... Got it.

Take it to court and you'll likely end up with a bigger ticket.

Suck it up and pay the damn ticket. Everyone knows the limit is 50. Well apparently not everyone....

Look it up in the Highway Traffic Act. 50 in built up areas, and 80 in open areas, unless posted.
