Speeding Ticket

Well I got a speeding ticket on Good Friday, 29Km over the limit. Went to one of those traffic ticket places and the guy said he could possibly get the points off but I would have to pay the fine, $138 and his fee would be $250. Has anyone ever used one of these places? Is this the standard rate? He also said there were no guarantees so I could end up with the points and fine and his fee. Any advice?

You could probably do just as well on your own in front of the judge and save the $250.00

I've found that where you get the ticket to be very important ... In TO the mass amount of tickets being heard everyday = more chances of reduction ... out in Lindsay or smaller locations ... lesser chance

Plead not quilty. Attend the court hearing/trial.

If the policeman does not show up, the case is dismissed. You "win".

If the policeman shows up, the court clerk usually will tell you if you plead guilty now, it will be within his/her powers to grant a reduction of fines & sometimes no demerit points deduction as well. You "win".

Even after pleading guilty, you still have a chance to plead your case B4 the judge for lieniency, who may or may not give you a further reduction. You "draw".

The above is assuming that you have the time to do it.

If you don't have the time, plead guilty, pay the fixed fine. You "lose".

Forget about those traffic ticket companies, DIY, save the money & spend it on your favourite SPs.

what? more clogged the better, everyone who gets a ticket should go plead guilty with explaination... the ticket will be so delayed, by the time u get court date, it'll be 5 yrs later... and noone will remember a damn thing, maybe the cop isn't even a cop anymore...

agreed!

they don't do anything special... i been to the court 2x, all they do is show ur ticket to the clerk, and they reduce the fine and points.... when i show my ticket to the clerk, i didn't even say anything except for "OK" after he told me the reduced fine and points...

go to court urself, and afterwards, go find a MP to relax...maybe a duo too cause u saved 250

Dragondick is right on the money. Do exactly as he says becuase that is exactly what the traffic tickets "expert" guy will do and then charge you $250. Also, if a cop can find anyway out of going to court to defend tickets, he will. Unless it is his off shift and can get paid overtime to appear, then he is a gauranteed show. I've heard people will bring a buddy and if they see the cop is there, send the buddy in to ask for a new date because you are out of town. I'm not sure that works anymore. Most people just get the clerk to reduce the ticket and pay the fine.

no, i mean guilty w/explaination...

there are 3 choices, guilty, guilty w/explaination, not guilty...

to reduce fine and points, just plead guilty w/explaination

what i am not sure is if the cop don't show up and you guilty w/explaination, does the ticket still get dismissed?

guilty with an explanation is not a defence, the judge may or may not take it into account when sentencing, keep in mind anything that you say will be used against you, the guilty part specifically. Some trafficc ticket places have a don,t pay if your found guilty payment plan give them a call .

Guilty with explanation, which I did once, was done in front of Justice of the Peace. He recorded the conversation and reduced the fine and points. No cop present.

my plan would be:

- not guilty
- change date
- show up in court
- check if cop is showing up
- if he is not there woohoo
- if he is there, approach prosecutor/cop for deal

you will not win with cop there

Last ticket I got (30 over) I had Pointts deal with...

They got the speed reduced and no demerit points ...

The Cop did show up, bear in mind on the 401 its probably a "Traffic cop" and his schedule includes court dates ... he/she will be there !!

Anyway I used points because I didn't need to be there... Faxed the ticked signed the form faxed it back ... and paid

I don't get paid if I'm not at work so not losing a days pay and paying the Pointts guy put more money in my pocket ...

if you have time , plead not guilty , reject the first court case given, and hope the cop isn;'t on schedule for the new court date ...

I don't know about Ontario specifically. But in most places an excellent way for a Police Officer to find themselves suspended or terminated is to fail to show up for court without a legitimate excuse and having requested the Crown to ask for a continuance.
