Los Angeles, California (CNN) -- A well-known Mexican soap opera star and her American husband face federal charges of entering a sham marriage so she could get legal residency in the United States.

The government said the fake marriage was exposed when a jilted boyfriend, fashion photographer Markus Klinko, called the U.S. Immigration and Customs Enforcement agency.

"This actor should have realized that posing as a bride for immigration purposes could land her a role in a real-life crime drama," Special Agent Miguel Unzueta said.

The 28-year-old Romero appeared in at least 15 television shows and films since 2005, according to the Internet Movie Database, when prosecutors allege she paid Kent Ross, a pizza delivery man and musician, to marry her.

Romero appeared before a U.S. magistrate on Friday and was released on a $50,000 signature bond. She was ordered to surrender her passport and not to leave Southern California. Her activities will be monitored electronically.

The prosecutor in the case, Assistant U.S. Attorney Jim Left, said Romero could get between 15 and 21 months in prison if convicted, though such cases usually produce shorter sentences.

Ross appeared before a U.S. magistrate on Friday and was released on $25,000 bond.

The case is unusual because marriage fraud charges are usually litigated by immigration authorities rather than prosecuted as criminal cases.

A federal complaint filed Thursday accused Romero of paying Ross, 28, to "marry" her on June 12, 2005, but alleges they never lived together as a couple.

Romero began dating Klinko a month later, and they lived together for several months, the complaint said. After Romero dumped Klinko, the photographer "presented ICE with evidence that Romero was in a sham marriage," the government said. (Ah, the old jilted lover revenge thing) :rolleyes:

The complaint names Michael Ball, founder of the Rock & Republic jeans company, as a target of the federal investigation, alleging that he helped arrange the sham marriage while Romero was modeling for his company.

The judge barred Ball from helping Romero post bond on Friday.

Romero's publicist did not return calls seeking comment Friday.

Her biography posted on her IMDB page listed Klinko as one of several photographers "who noticed her on-camera appeal, opened Fernanda's eyes to acting opportunities in Hollywood."

Romero's show business career began in Mexico at age 16 when she joined the ensemble Frizzby, the biography said. The group toured Mexico and Central America, releasing two top 10 singles, it said.

She started hosting television shows and appearing on commercials in Mexico when she was 18, it said.

Romero has appeared in print and TV ad campaigns for Rock and Republic, Clean and Clear, Pepsi, Apple and JC Penney , it said.

No tears in my eyes over immigration fraud. It is hard enough trying to help honest people through the system without cheaters poisoning the waters.

Further, how damn stupid can one person be. Marry hoping to get permanent residency and them start dating someone a month later!

Just a second, here. If this lady is an established Mexican tv star that makes her an "alien with special talents" under US immigration law. Why would she have to do a fake anything? She simply lines up a Hollywood agent, auditions for roles and gets her green card when she gets taken on by a series.

If the girl documented the attempts of ex-lover to sleep with her in exchange for not disclosing the info and he got charged with extortion, there would certainly be no tears in my eyes over carma in action.

The girl is a scheming cheat, her ex is a rat, and the pizza dude "hubby" is a goof. Plenty to go around in this lot.

Well she can't predict for sure that he's an untrustworthy rat. But she has to understand that some people who get dumped are often bitter and will try to lash out at you angrily. Her best move was to be as squeaky clean as possible with her "husband" during the whole charade.

Absolutely Oagre. Seemingly from the article she should have been able to qualify for a O-1B Visa on her own. However, we all know that people do stupid things.

However, since I'm not involved in the case, and since she decided to do something both stupid and criminal. . . .

Assuming the complainant isn't making this all up as an extortion attempt......... I mean, this woman isn't your starving desperate wannabe who thinks all she has to do is get to H-wood and smile. She's successful in her home country and presumably has access to sophisticated advisors who will hook her up with a reputable agent who will fly her in for auditions with proper Immigration permissions, etc.

I smell a rat in this story.

Perhaps Michael Ball, founder of the Rock & Republic Jeans Company, who supposedly helped arrange the fake marriage really doesn't like her very well at all.

U.S. Attorney's Offices certainly can engage in overkill, but I have no doubt that they have plenty of evidence for a conviction.

I just checked IMDB and all of her film credits happened after her 2005 marriage when she could come to the U.S. to work in Hollywood. She only had a couple of non-starring bit parts on 2 Mexican TV soaps prior to 2005. Once coming to the U.S. to work in Hollywood she's had 19 roles in movies.

It would seem highly unlikely she would have qualified for an O-1B visa. A bit part on a couple of daytime soaps does not qualify one as a film star/tv star.

"The O-1 classification is a type of employment visa under United States immigration law that applies to aliens who have extraordinary ability in the sciences, arts, education, business, or athletics which has been demonstrated by sustained national or international acclaim and who are coming temporarily to the U.S. to continue work in the area of extraordinary ability.

An O-1 visa is initially granted for up to three years. Subsequently, it can be extended for one year at a time; there is no limit to the number of extensions that may be granted. The term "O-1" refers to 8 U.S.C. § 1101(O)(i) (also known as Section 101(O)(i) of the Immigration and Nationality Act), which provides for the admission of "aliens of extraordinary ability" in the stated fields."


So if you are a movie star in the UK, you can get an O-1 to work in Hollywood on a film you have been offered a role in. If you are a young starlet wanting to do casting calls in LA you do not qualify for this type pf visa. A marriage would have allowed her to do casting calls and auditions to build up her career, which is what she has done the past five years.

Thanks for the added info. I used to write plays and screenplays as a hobby back in the 90's and knew many actors, some of whom concocted Immigration marriages to get to LA and work there. Most of them were nice, talented young people who would likely never do anything else criminal or dishonest in their life. They were just desperate to get ahead in a very competitive and rarely successful career. I feel sorry for this young actress.

Typically I feel very sorry for such people and would like to wave my magic wand. But if you are going to play the Green Card Marriage Game at least try to pick someone you honestly feel at least some attraction toward, and give the marriage an honest shot.

I know this is hopelessly optimistic, still. . . Certainly I’m not going to counsel someone to commit immigration fraud. As the maxim goes if someone is going to be convicted make sure it's the client not you.
