My mother Died about 5 years ago now ( Dads been gone longer) and my Older sister is the executor of the estate. For some reason unknown to me or my second sister, the executor one, doesn't want to close out the estate. We have asked numerous times whats happening and we just keep getting feeble excuses about the Lawyer, stocks being from the US etc. etc.
My question is, what can I do to move things along or because she's in charge do I just have to wait things out? Do I get my own Lawyer to do something or is that just a waste of money. Getting a bit tired of waiting for the inheritance.

From my experience it took about 2 years to dot the i's and cross the t's on my parent's estate, although, 98% of the money was divided up in the first year. Only some minor details remained after that time.

My siblings and I never fought about anything for a second (fortunately, we all are fairly level headed and trust is a given).

The last thing we closed out was the bank accounts having kept them open to deposit cheques and write cheques from. Once that was over, it was over.

In Ontario there are some simple steps you can take to compel her to finalize the estate. The law gives the executor one year to clear things up and distribute.

The problem with your question is that what steps you should take depends on the terms of the Will... if you were named in the Will she was required to give you a copy.

Take that copy to a neighbourhood lawyer for a consultation on what to do... it won't cost you a lot of money... you don't need a Bay Street superstar to give you advice.

handle an estate with honesty and be open and you should have few problems..........do anything else and you shall be in court
