If you have a home office and smoke there, better be careful.
its good to uphold the law but shouldn't he be doing something better for the public.i can think of a whole lot of things.

heres a though;
trucker driving his rig down the road smoking his/her cigarette gets pulled over and charge for smoking.

trucker pulls over for his rest parks for the night. he/she lights smoke.but now isn't his/her truck now home and not work.

This is just another retarded law so the Communist Government of Ontario can rape you for your money. I hope the guy takes it to court and wins. I know I would. These Govt. assholes have just gone too damn far with their bullshit laws.
It might be considered his workplace but he is the only one in it. Does he drive for a company or is it his own truck? If it's his own truck then he should have the right to smoke, after all he was the one who paid for the truck and no one else would be driving it.

Something seems a little fishy here. Either the cop was having an exceptionally bad day, or he had it in for the truckdriver for some reason, or somebody orchestrated this whole thing just to get a chance to fight the law in court?

I agree with the Piggy 100%. And I think it was a female cop. Obviously with nothing to do - not enough crime, no murders, no theft, etc, etc.

smoking is getting weirder and weirder. Michael Jordan was reprimanded for smoking a cigar on a California golf course. the course is city owned so therefore is smoke free.

Did we go back in time? Is the year now 1984?

Yes, Big Brother (not the TV show) IS watching! Can the Thought Police be far behind?

This is what we have come to? This is nothing but pure harassment! The officer who laid this charge is an idiot and cannot be trusted with a deadly weapon! The manager quoted from the County Health Unit is just as nutty!

This ridiculous interpretation of the law needs to be fought and overturned, otherwise the next target WILL be home-offices.

So it is illegal for a truck driver to smoke a cigarette in "HIS" truck now? So now he slows down and pulls over to the side of the highway, gets out of the truck and has a smoke, then pulls back on the highway. He now slows the traffic on two separate occasions, slowing down to pull over and speeding up when he gets back on the highway. There is two very plain and clear dangerous instances that could and likely will cause accidents. Then he/she is supposed to stand on the side of the highway to smoke a cigarette? Another clear realization of a driver taking a chance of getting hit and/or killed while getting in and out of the truck. I find this surprisingly stupid and dangerous that they are no longer allowed to smoke in the truck. And I am not a smoker!!!!!!

Firts they did it with tobacco. Soon, they will pick on some one else's vices. Already, these do-good nannies are thinking about soda pop and hamburgers. Wasn't it in NYC that they banned trans fats?

When will the madness end and they treat us like responsible citizens who can make up our own minds?

From the Smoke-Free Ontario Act:

"The act seeks to protect employees from exposure to second-hand smoke in an enclosed workplace. An enclosed workplace means the inside of a building, structure or vehicle that an employee works in or frequents during the course of their employment (whether or not they are acting in the course of their employment at the time)."

"Examples of an enclosed workplace include the inside of a trailer office on a construction site, the inside of a loading dock, or the inside of a delivery truck. The ban on smoking in an enclosed workplace is in effect at all times, even during off-hours when people are not working."

I am not a fan of smokers but I don't think we need any edgy truck driver because they can't get the nicotine fix.

So basically anyone that has to drive a car/truck as part of their job. And even if you you're just driving home. Nice.

Neil MacKenzie, the manager of tobacco programs for the Windsor-Essex County Health Unit, said even a farmer's enclosed tractor would be considered a work environment.

“Technically, that would be the workplace and it'd be an enclosed work environment,” he told Windsor radio station CKLW.

“Whether or not you have the sunroof open or windows down ... it's an enclosed workplace and you're prohibited from smoking in that vehicle.”

dumbest thing I've ever heard.
