A Ticket for Garbage!?!

I was wondering if somebody on Terb can help me out.

This morning I recieved a ticket from my landlady. It was ticket for illegally dumping my garbage.

I live in an old building in the downtown area and I have to dump my garbage in a shed instead of a dumpster. Somehow, my trash managed to find itself a couple blocks away, (racoons? crackheads, who knows?)

The result is that I have a ticket or an Offence Notice that states that I have to pay 130.00 dollars.

I have three option in regard to this ticket.

[1] Plead guilty and pay the ticket.

[2] Plead guilty with an explanation ( I have to go 137 Edward Street, Provincial Offence Office)

[3] Take it to trail

There is also a fourth option, ignore it which of course in the long run is usually not a great idea.

I'm thinking that the second option is viable. Do I just plead guilty and provide an explanation and then I don't have to pay the fine.
Has this happened to anybody?

Usually I tear up any documents and letters with my name on it and dispose of it seperatly, but obviously I was a little careless.

Thanks for any advice that you guys (or gals) can give

Is your Landlady a Toronto garbage bylaw officer???
Why would she give you a ticket, or is she just passing it on from the garbage police?

I'm betting that she is passing it on, but shouldn't the building be held accountable for not securing the garbage once you deposit it in the shed? I would go to trial and argue that you are not responsible as you put it in the designated area. I'm sure there were other tenants' garbage that was strewn about unless yours was the only garbage in there. Yours was probably the only garbage that was identifiable. I'm not a lawyer, so don't take legal advice from a jack ass like me, but that's my opinion.

Don't plead guilty with an explanation. Depending on who hears the case, they may just hear the guilty plea and your explanation means jack. Plead not guilty, and use the time in court to dispute the ticket.
Weigh your options. Sometimes the day off work costs more than the ticket. Since this is a by-law ticket, it won't hurt you in the future like a speeding ticket would (on your DL and affects insurance costs)

If the landlady was passing the ticket along, she is actually accountable for the ticket and you do not need to pay the fine at all. If she pays the fine or takes it to trial, her only action could be to sue you for the amount of the ticket. If you were not issued the ticket, you are not responsible for the ticket.

Goober, one day I'm going to go out on a date with u, strip u down, tie you to a tree and call in every MPA I know with a fun saver to take pictures.

The landlady was just passing the ticket.

She had a few tickets with her; and I assuming that she had more since I live on the top floor and I was probably one of the last tenants to recieve the fines.

The ticket is in my name; guess they got it from sifting through my garbage.

I have two words for you, my friend - paper shredder. I wouldn't plead guilty w/an explaination, I'd plead not guilty and take it to trial. It's their burden to prove that you did in fact strew the garbage and did not place it in the shed - if they appear at all. Good luck.

i like number 3...take it to a trail....hike up the mountain..when you reach the top, tear it up, throw it in the air and yell "Take that garbage Nazi landlady" then wait for the echo.

That's good advice for everyone, otherwise you are leaving yourself open to identity theft --- nevermind tickets for garbage.

(When I first read the topic headline I thought there was a ticket for sale to see the band Garbage. :eek:)

Feel free to come by my building and investigate. Obviously you seem to know more about my situation than me.

Why would I lie about dumping my own garbage? Especially on Terb!?!

I can dump garbage in the shed anytime. There is no garbage day; if I miss the garbage pick up, it is no big deal.

I would not dump garbage illegally. And I do not have to.

Before jumping to conclusions and making assumptions about people you don't know; why don't you have the courtesy to ask about my situation? I would have been more than happy to answer any questions had you been a gentlemen about it.

Other than that, I think I will take the ticket to court.

Sort of on line with this thread.

A friend of mine was working on a large construction site in Vaughan one time, and came to work on morning to find a big pile of old roofing shingles and roofing debris dumped on the site.

Well, he sifts through it and finds an Invoice for the NEW roofing material that was delivered not too far from there.

Called the cops.

They came, took the invoice and drove over to the house to find Nick the roofer and his crew putting the finishing touches on the new roof.

Needless to say, that idiot roofer didn't make any money on that job.
