Another speeding ticket scenario

Helllo,

Well, as I was going with the flow of traffic ( 2 cars ahead of me) on the slow lane, coming of a bend on the road we all encountered the dreaded radar trap.

The cop who was standing on the sidewalk jumped onto the street and signalled me to turn over to the side of the street.

Now, my speeding is not that bad - going 63 km on a 40 km zone.
The cop (being the bacon) that he is handed me a ticket without as much as a discount.

Now, I'm wondering if the cop has any validity that the radar did catch me and not the 2 cars ahead of me.

Also, the cop didn't show me the speed on the radar.
What's to say that he won't make up any number up? Good thing I was quiet. I can imagine being porked over if I had mouthed off to him!

Now, I don't have time to fret over this but I know I shouldn't choose Option 1 and just pay the fine.

Option 2 is to plead guilty with an explanation. Will doing this give the justice of the peace some room to knock the speed down thus saving me 3 demerit points?

Or should I file for Option 3 and go for the trial. I know I'm guilty but I don't want to screw myself up? On the actual trial date, could I plea bargain with the crown attorney so that I don't have to look at the ugly pighead.

I'll appreciate everybody's feedback.

Thanks

Thanks LBD,

Good thing I wasn't going to a MP. That would really bite!
- Upon receiving his speeding ticket, The Finisher turns around and drives home blue balls and all!!

I'll file it at the courthouse for a trial. Hopefully, it'll take eons before a trial is set. Most likely I hope to plea bargain it down.

Gotta love those cops. NOT!!!

Aw, lay off the cops. They are just doing their jobs, and if you weren't speeding they wouldn't pull you over (well, most of the time!)

Sure there are a few bad apples but its the same in every profession. Everybody hates cops until they need them.

radar traps

Yeah right,
If the powers to be really want to reduce speeders then there would be no traps, the cops would be in plain sight.
Otherwise this is revenue generating plain and simple.
I heard that T.O. generates more money from traffic and parking tickets than even NYC.

That's bullshit, NYC cops are fucking bloodsuckers, they will try to find the tiniest thing to give you a ticket, they even have these special golf carts to drive along sidewalks and ticket parked cars.

Out of 4 tickets cops have given me 3 of them were cancelled due to the cop not showing up in court.

Your Options

Option 1: Pleading guilty and paying full fine is a no win proposition and should never be used.

Option 2: Guilty with Explanation - in this scenario the judge will not be able to reduce the speed but in 99% of cases will decrease the fine.

Option 3: Trial - in this scenario can still plead guilty with explanation but the judge has the authority to decrease the charges and reduce fine ... possibility that the cop doesnt show up ... many cases thrown out if the crown cant get to them on time.

So if you can spare a day and willing to go to court best bet is Trial. What do you have to lose?

Nothing to loose going to trial if you can spare the time.

Plus, it makes The System 'work' for its money.
It's too easy to milk the populus when everyone is so willing to just pay and be done with it.

This is a law that 95% of people break on a daily basis. It shouldn't exist. It really burns me when I see cops doing 120 on the 401. How can they enforce these laws when they're so blatantly breaking them? And BigGuy...don't try to tell me that it's just a few bad apples. I'm sure the vast majority of police go faster than 100km/hr on the 401 on all but the rarest of occasions.

I still find speeding tickets to be one of the most useless fines you can be hit with. If you're being an idiot by driving fast when it's raining or snowing, or if the roads are crowded then you deserve a ticket.

But the natural in-town speed is generally 65 km/h, so as long as things are flowing I really don't see anything wrong with that. Ditto driving more than 100 km/h on a 400 series highway.

To The Finisher, you have the right to request court appearance in French. It's unlikely that the cop will show up so you'd likely be OK. Just be prepared in case he does show up (have French speaking representation if you can't do it yourself).

100km on 400 highways???

Who drives 100km on 400highways? I don't know how anybody can drive only 100km on 400hwys. I fall asleep driving 100km. It's so boring. I also have to agree with remarks driving 65km in city is perfectly acceptable... if following the natural flow of traffic. Of course speeding in a school zone or playground area though is unaccepatable. If they have to be out there with radar guns they should be in areas where there are lots of kids near the roads.

Wherever I shouldn't be
I recently got a ticket in Grey County, 113 in an 80. The West Grey Police offered option 4. Option 4, startlingly, did not involve me on my knees for the boys. Here's the deal. Go to Durham, pay $80.00, write a 10 question multiple choice test. 7/10 = no ticket. If you don't get 10/10 on this test you are not qualified to ride in a car, let alone drive one. This option is available once a year, but I think only in West Grey jurisdiction.

Hey Rixon, you're right, the cops drive way faster than the posted speed limits all the time. But, are they going to ticket themselves? Thats their job Rixon, to nab everyone else driving faster than the posted limits.
