Does anyone here have any experience in small claims court? I might have to take someone there. I vision it kind of like Judge Judy, but maybe I'm wrong. Also would mind sharing my details of the case with anyone has knowledge of this sort of thing but would rather do in private so a pm would be great. Any help would be greatly appreciated.

Yup. And won. Not as much as we wanted. Depending on the value you can do it yourself or hire a paralegal.

We had free advice from a lawyer friend.

Is it kind of like Judge Judy? My claim would be for about 2Gs so I planned on doing it myself.

Not so dramatic. But yes. It starts with an attempt at arbitration. If that doesn't work out then it goes to court. Each side presents their case. Can call winesses.

Make sure you have all your paperwork. We also made copies for the judge and the other party. Tab it for ease to find things.

Present it dispassionately. Look up case law if you can. Ours wasn't decided by what we thought. They don't care nessessarily about right/wrong but just the law. It wasn't overtly adversarial. Judge asked questions.

Small claims court in toronto is worthless. It is best to get a lawyer to help you. I sued a scam company in court. Got a default judgment because the defendants didn't file a defense claim. I never got the money owed because after I sued them, I found out the defendants have been scamming people for years and fled to country

Winning is the easy part. Collecting is another story. They ignored my claim so I won.
You have (at least 12 years ago) two choices afterwards.
Garnishee their wages or garnishee their bank account. I knew where they worked so I garnisheed their wages. I got all my money back including court costs and interest.

That is the real question: even if you win, will you get paid?

If you are going after a person, make sure they have a job you can garnishee ( very easy to do with a win).

If you are going after a business, all you can do is put a lean on some of their property ( car, building if they own, etc) and you get paid when they sell.

might want to settle just to get something.

If you are awarded by the court...you WILL get paid. As long as they have declared income you will get paid.
Make sure you bring all the evidence and witness that you think will help your case. And remember you won't be the only one getting help from a lawyer or paralegal. you both have rights. Any documentation you have you think will help make sure you have them.

I going after a buisness/person, so I know where they work...lol.

It's only 2100.00 bucks, so I can't see why they would put a lean for something so small.

Fuck it, I'll spill the beans. There won't be that much paper work. It's only 2Gs but I feel it's worth fighting for. I paid for my car to get fix by a mechanic who misdiagnosed the problem, and is now telling me it's going to cost more to fix the car then what it's worth. Obviously if he had of got the original diagnoses right and told me the car was unfixable, I wouldn't have paid the 2gs for the other work to get done.

What I read and was told by a lawyer back when I took someone to small claims court was....when you garnishee someone’s wages through the courts it then becomes an issue between the business having to do the garnisheeing and the Ontario courts. Not sure if that’s still the case. Good luck.

Of course it's worthless in your situation...lol. If you get scammed by a Nigerian email, Ontario small claims court isn't going to be able to do fuck all about it...lol.

No it was a company that placed ads in newspapers saying they were looking for adult models for adult movies they expect people to pay them for photoshoots and pay more ti be in their movies

I understand that...lol, but it's the same principle. What I'm saying a shady company that fled the country. Good luck. It's a different ball of wax when your going after a legit buisness.

The owner fled the country but he close the adult movie office and change the address to a private UPS mail box. It was registered under the ministry of govt services and on it it says "active"
