One does not need to apply for a pardon if they receive absolute or conditional discharges. They come off CPIC system automatically. An absolute discharge comes off system after one year. A conditional discharge comes off system 3 years after term of proabtion has been completed.

What if the charge was dismissed? Does it show up at all on CPIC?

You must make a request in writing to the police to have your fingerprints destroyed if the charge is withdrawn or stayed.

If the charge is withdrawn or stayed - the charge should not show on CPIC. However it will remain on the system in the police division that booked you.

And if you attempt to enter the US with o/s charges - they will likely run a check and it will remain on their system even after charges are withdrawn or stayed.

Key: do not lie to US immigration or you will be flagged forever.

Is that the same as going to court and winning?

Also, how long does it usually take for the cops to destroy them? Is there a way to check?

You used the term "dismissed" in an earlier post.

If you win at court after trial - you are acquitted. It takes about 6-8 months for fingerprints to be destroyed once request is received depending on the police division.
