any lawyers out there? got into a terrible car accident and other driver is clearly at fault but no witness and police didnt come to the scene because friggin tow drivers carted me away to the police reporting center quickly after accident.

Now my insurance premiums can triple. Is there anyway to fight this? Stated my case to insurance company but they say the only way to be NOT at Fault is if I have a witness or the cops fined the the other driver. With a bit of logic, some physics and examing the impact points, they should be able tell who is lying !!!! But because of no fault they are going to pay me out and charge me through the nose.

What are my options? There is no justice!!! Some help!!!

Nuh-uh. I recently got rear-ended <insert joke here> and I went to the police reporting centre. No witnesses either, but I don't have to pay the deductible and my rates aren't going up. But I suppose getting rear-ended <insert joke here> at a traffic light may be cut and dried in terms of fault.

I'd plead my case to the highers up at the insurance company.

I was also a victim recently... I was violated from behind.

There was no damage to the other guy.. but I needed a new bumper.... I got his info, lic#, insurance policy #, plate number... I reported it at the reporting center... the other guy should have just asked me not to go through insurance... because according to my insurance company the fault is 100% his, which should result in a very, very large increase in his premiums... he was also a young driver (18-19)

The good news is that when you are rear-ended, it does not even count as a claim

I wish i got rear ended because its clear. But what happen to me is that a tractor trailer didnt see me on his blind side and he turned hit my rear wheel and spun me out and I crashed into another car. He claims i drove into his lane to avoid a merge lane. Which is a complete lie because I wanted to be in a merge lane!

I'm fuming right now. My car is a write off. This sucks big time.

when the police say it is the other guy's fault, that is not what the insurance company bases its decision on, totally... often times the insurance company will say it is 10% your fault... when there was nothing you could do to avoid the accident... their argument.. it is 10% your fault "for being there"

Isnt the guy who hit you from behind automatically at fault since he has the duty [insert comment here] to avoid hazards in front of him, barring action on your part to cause the accident (like stopping in the center lane on the 407)?

there is a show on city tv sometimes with a Christine romanov, i think that is her name. Very insightful on how the insurance co's work. Basically amongst the insurance companies, they have a system on how to assign "fault" to determine which insurance company pays what and to whom. This determination is irrelevant to what you, the police or witnesses may think.

I also think your insurance premium will go up regardless. They seem to base rates on "claims" rather than who is at fault. It use to be that they would look at your last three years to see how many claims you have made, now it seems they are going back as far as 5 or even 7.

After 9/11 and the markets, these guys are really weeding out non-profitable customers.

I had my car stolen in 95 from a parking lot, obviously not my fault. In 2000, someone banged into my door again parked in a parking lot, again not my fault. Did it matter, nooooo!!

State farm decides to increase my rates by 80%. I went to the companies obudsman to protest. Eventually, it only went up 200$ for the year.

Dont waste your money on a lawyer, totally not worth it!!
