The globe and star article quoted witnesses who said that the car appeared to be under control, and looked like it was intentionally trying to smash the cyclist into objects along the side of the road. In fact, the car appears to have crossed to the wrong side of the road just so so the cyclist, on the driver's side, could be smashd into the objects over there.
So yes it appears to have been intentional, hence the criminal charge.
The guy was scared... he freaked out. I would too if some dude was hanging off my car.
His subjective state is irrelevant. This is an objective question. Would a reasonable person in that situation have felt that his life was in danger?
Initially? Yes.
Later when the cyclist is helplessly dragging along beside the car? No.
The cyclist was killed at a time when he was helpless. The best analogy is let's say somebody jumps you, gets into a knock down fight, and you punch them out. While they're lying on the ground curled up helplessly in the fetal position you go on to give them a few more kicks and then jump on their head and kill them.
Were you initially justified in punching them out? Yes.
Were you justified in killing them? No.
