Your friends still need waivers every time they cross the border, because US Law enforcement did a criminal check with the Canadian Law enforcement before the pardons and now the information is in the US database even if gone from the Canadian database. I have been told that its almost impossible to get anything removed from the US database.Ok I withdraw my comment and suggest your nephew gets advice from a knowledgeable source that he can trust. I was simply paraphrasing some of the things I learned from people I know well who have trouble crossing the border for minor offenses committed decades ago. In both cases they received conditional discharges and obtained pardons but have to obtain USA Entry Waivers each time they want to enter the US. Both have received ample legal advice. If your nephew is sure that he was never charged, fingerprinted and never went to court yet he has a criminal record, then he should perhaps get professional legal advice. Unless your nephew is not being entirely forthcoming with you, then perhaps he has been the victim of a clerical error by LE which has been known to happen.I have a nephew who is beyond upset and needs some advice. He needed a Police background check for a volunteer position he wants .He received it today in the mail and it states somehow he has a Criminal Record. He was able to renew his passport recently, cross the border with no issue what so ever.I was with him one time crossing the border. He was arrested once few years ago but was never charged,never finger printed ,never went to Court or jail. It says that his birth date and fingerprints match a person with a C.R. He is devestated as he was planing to apply to RMC next year.
Any suggestions I can offer him? He is really confused and upset.
Except that's not what he got according to the OP. A vulnerable sector check which is needed for volunteering is not the same as a criminal record check and will include any interactions with police, even if charges were not pursued....
A criminal record check only comes back if you have been convicted of a crime. Hence the term "criminal record".

Agreed. And the border cops don't ask about convictions, they ask whether you've been arrested. They already know and it's a truth check.More bad advice here. Americans are quite liberal about letting you into there country, even if it shows you been arrested before....
Don't believe that impacts a vulnerable sector search (or the US border questions).Encourage him to pursue applying for a pardon. This will keep resurfacing. Samething happened to a close friend of mine.
