Kidnapping

Bribery
Obstruction of justice
This is a big win for the prosecution, and could put the kidnapping charge in the red column

Pop Star Usher and Barack Obama Named in Diddy’s Sex Trafficking Trial
Singer Usher and former President Barack Obama were both named in testimony during the sex trafficking trial of rap mogul Sean “Diddy” Combs on Monday.

The court heard testimony from Diddy’s ex-assistants, ex-associates, and his ex-girlfriend, Cassie Ventura, as the trial rolls into its third week, Fox News reported.

Several other A-List names also came up as those called to testify spoke about the parade of top celebrities and music industry persons who attended Diddy’s events and parties or who otherwise had some connection to the matter. Along with Usher and Obama, names including Biggie Smalls and Jennifer Lopez were also mentioned.

As for Obama, Combs’ former assistant, David James, testified that Diddy used to take pills shaped like Barack Obama’s face. And he added that Diddy traveled with a bag containing “25 to 30” types of drugs.

During her testimony, Danity Kane singer Dawn Richard claimed that singer Usher was in attendance at a dinner where Diddy punched Cassie Venture in the stomach as they argued. Richard added that Usher was there along with Jimmy Iovine, Ne-Yo, music executive Harve Pierre, Kaleena Harper, and two more of Diddy’s assistants.

Other celebs mentioned so far during the three-week trial include rapper Kid Cudi, who was said to have attended some of Diddy’s “freak off” parties, rapper Notorious B.I.G., singer Rihanna, Suge Knight, Brittney Spears, Prince, and actors Michael B. Jordan and Bruce Willis.

Other names linked to Diddy’s “freak off” parties include actors Will Smith and Ashton Kutcher.

Indeed, it has previously been reported that Diddy has enough dirt “to hang half of Hollywood.”

But federal prosecutors warned jurors that the trial was not about celebrities.

In her opening comments, prosecutor Emily Johnson described Diddy as a violent offender who had set a man’s car ablaze and dangled a woman from a balcony, as well as making impossible demands of his lovers.

“Let me be clear… this case is not about a celebrity’s private sexual preferences,” she said.

“It’s coercive and criminal” in nature, she added as Combs watched intently.

I really don't like Harvey Levin from TMZ but I have to agree with him on this point:


There's no way the government has proven a RICO case against Diddy.
I'll be very surprised if he gets convicted of that

In a stunning move, the day before closing arguments in Diddy's federal criminal trial in NYC, prosecutors have pulled back on some key testimony during the trial -- specifically attempted kidnapping, attempted arson, and aiding and abetting sex trafficking.

Prosecutors seem to feel they've fallen flat on proving Diddy allegedly kidnapped former employee Capricorn Clark (who was taken to a building and given a lie detector test to determine if she stole Diddy's jewelry), and Cassie (when she was allegedly held at the London Hotel).

More surprising ... prosecutors are not pursuing the attempted arson claim that Diddy blew up Kid Cudi's car in a jealous rage. During the trial, prosecutors never directly linked Diddy to the fire. Both of these charges relate to the racketeering charge Diddy faces.

As for the aiding and abetting sex trafficking charge, prosecutors don't explain what elements of sex trafficking they will 86 from the jury instructions.
Prosecutors are NOT dropping the various sex trafficking charges ... only elements of them, and specifically aiding and abetting.
Prosecutors do say in their letter they want an instruction that just because women (Cassie and Jane) gave prior consent to sexual acts, it does not mean that it can never be withdrawn.

Prosecutors also say jurors should be told just because a woman (Jane) received compensation, "does not preclude a finding of forced labor (which relates to sex trafficking).
And as for sex trafficking, prosecutors want jurors to know neither physical restraint of the alleged victims nor commercial sex acts are required to prove coercion in sex trafficking.

But now many analysts are talking about the government having to only prove two of the predicate charges and them now possibly having done that. I'm surprised we haven't seen Kareena Korem his former assistant. I understand she's on good terms with Diddy and in that event, I'm surprised the defense hasn't called her. The defense has called nobody. I don't think it's the same story as a few weeks ago. Because the actual events have come out that tells a Rico story. What's worse for Diddy is his many Freak Off expenses were paid by "Bad Boy Entertainment." Technically that can be shown as Rico.

I have a feeling Puff Daddy is going away for a very, very long time… I think his only chance is Donald Trump issuing a pardon.

While being completely disgusted at how expansive RICO is and how little the U.S. federal government has to prove to theoretically convince a jury that someone has committed a crime involving conspiracy that could imprison him or her for countless decades.

RICO was designed for the prosecution of known mobsters. Not paid sex.

The government conveniently ignores the fact that the Mann Act was enacted with racial undertones, even though its recent resurrection is being used here against a wealthy Black man.

Those who argue that consent was not properly given due to the exchange of money might be advised to remember what the broad purpose of Terb is.

And it is quite interesting that this criminal prosecution involved such little discussion of minors. The civil proceedings talked extensively about the alleged sex with minors. The civil case will of course be settled with huge payouts no matter what happens in the criminal case. Probably irritates the civil case attorneys that the criminal case is taking so long. They want to start getting the money.

I'm very impressed. You really know your stuff with this whole case. It's very interesting. I grew up on Bad Boy artists so my whole entire youth is with this guy's executive productions playing in the background. The actions of Diddy are truly disgusting.

I know in the beginning of this entire ordeal, I think I even posted about it here, I was drawing parallels to Diddy and John Gotti… I think I was mostly relating that to the fact that John Gotti beat two charges (in New York) and full trials he was acquitted for.... (which was largely due to jury tampering), but regardless the government was so upset they finally got him with the RICO. The Rico stature is very broad. I can't believe one of the predicate charges to convict under Rico might actually be the car bomb that Diddy allegedly put in Kid Cudi's car. That's crazy. They actually might get two out of the 10 listings for Rico.

I don't really know about the Mann act and its application to this case. I'm going to read up on that.

He has laughed in the court system's face too many times. I think they got him. Too many boxes are checking off for the actual definition of Rico.
