Try it tboy, try using force against someone on your property WITHOUT asking them to leave, and WITHOUT having posted up a "no trespassing" sign. See what happens to you.

Even with a no trespassing sign up you are going to have to start out with a "Please get off my property" as the minimum force necessary plainly starts out with words.


p.s., you overlooked the "when prohibited" part, which is the part where the owner asks you to leave or tells you to keep off and you don't. Entry to a property isn't prohibited unless there are signs saying so, the property owner tells you to keep off, or there is a fence up around it.

p.p.s., the act you quoted is not part of the criminal code, violation of that act is not a crime, but rather a civil offence.

Sorry to kind of hijack this thread.
Once I was taking a walk around some nice quiet residential streets and I saw a Rot Weiler pooping on someone's lawn without an owner nearby and without a leash. Not knowing if the dog was pooping on his own lawn, but shouldn't a dog like Rot Weiler be on a leash at all time in an open area?
Well, I just calmly walked by without making eye contact with the dog and got the hell out of there.

Well, I'm not sure if the leash laws apply everywhere in ontario but I know in the City of toronto all dogs must be leashed at all times (when off the owner's property). You did right because they are pretty aggressive breeds......I would have called animal control immediately. Now not saying all rotties are bad, but if a breed (corrected from "dog") has demonstrated the ability to kill, they definitely shouldn't be out roaming around. You read stories all the time about pit bulls and rotties getting out and injuring people.....

Yeah, dogs should not be roaming the streets unleashed, animal control can and will pick them up. The dog could bite a child or something.

Worse, if it gets together with a couple of other strays they can switch to pack behavior and effectively attack an adult.
