TORONTO - Sex-trade workers will one day be able to legally provide for their families and work in Canada without fear of violence, advocates predicted Thursday, even as Ontario's top court kept prostitution laws in place for now.

A landmark court ruling striking down three key prostitution laws was put on hold until at least April 29, giving the federal and provincial governments time to appeal.

Dominatrix Terri-Jean Bedford, one of the three sex-trade workers at the heart of this case, said outside court Thursday that she is confident they will win in the end.

But she suggested Prime Minister Stephen Harper is hiding behind the courts on the contentious issue, and challenged him to "fight like a man."

"He can withdraw this appeal at any moment and change the law through Parliament," she said outside the court Thursday.

"His silence means that he does not know what to do and is not concerned about the violence against women."

Harper was asked about Bedford's comments after he made an unrelated announcement and seemed tickled.

"I've never been called upon to respond to a dominatrix before," he said with a smirk.

Harper said the government supports the laws and his government looks forward to fighting on appeal to keep those laws on the books.

"We believe that the prostitution trade is bad for society," he said.

"That's a strong view held by our government, I think by most Canadians."

Even with the full weight of the federal government on the opposing side, Bedford said she will continue to fight for the safety of other women. Unspecified disabilities have left her unable to "tie people up and spank them" as much as she'd like to these days.

"The only people who benefit from this law right now are tax evaders and organized crime," she said.

"The women need to be able to call the police when they're beat up by the pimps and the johns. As it stands right now they can't. They can't press charges because they're carted to jail along with (the assailants)."

Ontario Superior Court Judge Susan Himel struck down laws against keeping a common bawdy house, communicating for the purposes of prostitution and living on the avails of the trade.

That ruling was subject to a temporary stay, and the federal and Ontario governments argued the stay should be extended, lest prostitutes from all over flood to Ontario amid an unprecedented "social experiment."

On Thursday the Court of Appeal for Ontario granted another temporary stay, meaning the laws will remain on the books until at least April 29. It puts pressure on the government to expedite the appeal.

Justice Minister Rob Nicholson said the government was pleased with the stay, saying there are "considerable" harms that flow from unfettered prostitution.

"These laws are necessary to protect not only the individuals...but the communities as well."

"If the activity is carried on on the street and police are unable to intervene, this can have a devastating effect on communities and neighbourhoods."

Nikki Thomas, the deputy director of the Sex Professionals of Canada, said when — not if — Himel's decision is affirmed by higher courts and comes into effect, it won't mean that prostitutes will ply their trade on playgrounds and bring sexual anarchy to the streets.

"All that you'll see is one of the most marginalized groups in the country will finally have the opportunity to take care of their own safety," she said outside court.

Advocates say Himel's ruling, once in effect, will allow sex-trade workers to hire bodyguards and file income taxes.

In his ruling, the Appeal Court judge said it would be harmful to the public interest to have the lower court ruling come into effect immediately.

"I am satisfied that it is in the public interest that the judgment be stayed for a relatively short period to permit appellate review of the decision," Justice Marc Rosenberg wrote.

A current schedule worked out between lawyer Alan Young, who represents the sex-trade workers, and the government lawyers suggests an appeal will be heard in the summer. But Young said he is ready to argue the case tomorrow and urged the governments to press ahead so the appeal can be heard before the stay expires.

Young had argued because the lower court judge found the laws are "contributing to the danger faced by prostitutes,'' the laws needed to be off the books right away.

"It's business as usual for the government, which basically means a bad law will continue to be under-enforced," Young said Thursday.

Prostitution was not illegal in Canada, but the court struck down three provisions that criminalized most aspects of prostitution, however, Criminal Code offences dealing with people under 18 are not affected.

It's a court - not a Halloween party for Christ's sake. Why not have street walkers parading in the court house wearing thongs while you're at it. She makes a mockery of the legal proceedings and only gives ammunition to the right wing Moral Majority types looking to justify shutting the hobby down. All they have to do is point at her and say, "is this what you want your children exposed to?"

There's a time and a place for everything and Court is not a place to be dressed like a dumb ass carrying a riding crop.

She did "the cause" more harm, perhaps irreparable harm than good.

I watched her impromptu press conference with Alan Young this morning on CTV news at my gym. We need better, or at least more articulate, heroes.

I can't imagine her being the spokesperson for anything. She kept contradicting herself and giggling through the whole press event.

And just as I was trying to be supportive of Young's position, he argued that a repeal of the current laws would not result in a 5 story brothel, or what he called "the industrialization of sex".

So I thought, why not? If it's legal, there will be a high end Vegas brothel in our entertainment district.

On balance I am in favor of getting rid of those 3 laws. But I think there still may be a need to have some sort of law against pimping. Not as broad as the "living off the avails" law was being interpreted, but clear enough to deal with pimping. One way might be to say that any person involved needs a clear contract, and the contract cannot contain certain elements.

Perhaps contracts similar to sports contracts - minus the restrictions on leaving or playing for another team. In other words, a contract stipulating terms for both the SP and the agent or agency, but one that could be cancelled at any time. So it would have no monetary value and SPs could not be sold to another agent or agency.

I can just see Harper biting at this idea...lol

As far as I can tell this stupid pudgy dumb 50 year old cow caused the laws on prostitution to be struck down by a learned Judge. And since she is no longer a working girl, she did it for the good of fellow sex workers.

As someone else suggested, maybe if you don't have anything constructive to add except to (stupidly) denigrate someone based on their appearance rather than their accomplishments, then you should go back to watching Star Trek reruns.

I was in court in a corporate case once and I draped my trench coat over the back of a chair in the gallery. The lawyer representing the client told me to take the coat off the back of the chair because it was not proper courtroom behaviour and the judge would be offended (seriously).

I appologize for calling her a cow, it was uncalled for and said without thinking. I was wrong to do so.

However, she remains a clown for showing up in court dressed inappropriately and carrying a riding crop - irrespective of what she does for a living.

You don't walk into a court room, or even parade around outside carrying a riding crop. It's not the place for it. This is a serious trial in FULL view of the national media. You show up with a riding crop and Suzie B Homemaker gets very offended and starts writing letters.

If you want action to effect changes in the laws concerning the sex industry in Ontario in court you show up in a business suit, conservatively dressed, choose your words very carefully (or better yet don't say anything) AND MOST OF ALL - you leave the riding crop at home.

She turned a very serious trial into a circus and quite possibly did damage to the case. I saw her on television and just groaned when I saw how she was dressed.

(Let's keep in mind this woman was running an incall service in a residential neighbourhood and was busted for it (and rightfully so). IMHO, you don't run sex work out of a residential neighbourhood any more than you run a McDonalds.)

The law is being tried in an Ontario court - not a Federal Court.

Harper has no say in it and to speak out against him at this point in time makes no sense.

Although she has got the ball rolling I don't think the industry is being denied the opportunity to provide more articulate, professional spokespeople. This either means there is support for the way things are progressing, no one else is willing to stick their neck out and endure the scrutiny or the industry really prefers the status quo.
