You're right in asking those questions. However, the article states she is alleged to have stopped her car in the passing lane. Not very smart
With that I entirely agree, likewise actually getting out of her car. The problem is that the article doesn't answer a number of important questions.

I agree that the driver who parked her car on the highway should face some sort of punishment, but jail time is too severe. Like someone else said, there are far worse criminals out there that should be thrown in and kept in jail. Not to mention, this girl is just starting out in life so if she winds up in jail, she's basically finished; good luck finding a job with a criminal record especially for negligence. Here is another reason that dash cams and black boxes need to become standard in all vehicles. No matter how good the witness accounts are or how well the reporter did their research, no article will capture anything close to what really happened.

No one here is blaming the ducks on what happened Harry. I don't think the driver is blaming the ducks either.
