Ebay Scam - Help

I recently purchased a laptop on ebay and paid $2200 for it. I received an empty box in the mail. I opened up a paypal dispute, and the seller claims that he shipped out the item to me, however this is absolutely false. It's basically my word against his. What can I do next? How do I press charges? Will I need a lawyer for this? What's my next step? Please Help!

I had a similar problem about 2 years ago, although the item I bought was only worth $50.00 dollars or so. My item never arrived.
Since I paid for it on Paypal, I was eligible for the dispute resolution center run by ebay. I said my side. They said their side and I ended up getting my money refunded into my Paypal account.

The person I bought item from had something like a 96% rating on items sold which is not very good over 4,000 or so items sold. Read their feedbacks and there must have been about 100 complaints about what lying double dealing scumbags the sellers were.

If you paid for the item via a personal check or some kind of wire transfer outside the paypal system you are likely fucked big time. Very little ebay can do for you there.

in general when you pay for shipping you also pay for insurance along with it. Double check the ad and see is shipping included insurance, if it did go to the police. You might be dealing with an insurance scammer.

I received the package through Canada Post, and it had a tracking number. It wasn't really empty, it was just filled with junk and I did make the payment through paypal. The seller has only a 10 rating, however its 100% positive. I'm quite worried. The seller shipped the package to me from Montreal.

Sounds like mail fraud and you can go to the post office to file a claim.

and take a digital picture of the box and it's contents and email them to paypal.....it might help too if you purchased the item from the US and you find an item in the "junk" that has a made in USA stamp on it.

As for the weight, check the OEM site and see what the total shipping weight for a real laptop is and then check the shipping weight on the package. If there is like a 1 lbs difference, you've got a case because there shouldn't be that big of a difference.....

under the advise of a Canada post clerk, they recommend that if you ever pick up a parcel from Canada post or any courier center, open the package in front of the clerk that is present so all contents are verify on site..

this way there is a witness on hand and you have a name and source for dispute resolutions..

Did you make the Paypal payment with your credit card? You can phone your credit card company and have them reverse the charge. That is what I did after I did not received my package and Paypal refused to reimburse me. It was after their 30 days period.

I was just on the other side of this problem. Sold something worth about 100dollars, and the buyer claimed that they never got it, when I'm sure they did.

Had no tracking number, so basically it was my word against theirs, and I had absolutely no recourse. Paypal sided with the buyer and I lost 100 dollars. I consider it a lesson learned. The user had a terrible feedback rating, but I didn't notice until after.

Will probably not use ebay again because of this.

Speedball hit it right on the nose. If you are ever using Paypal always use your credit card. I know several people who went through this crap with Paypal and even if they find in your favour, if there's no money in the persons account you are screwed, and this judgement only applies at the time. If the person sells something else and money goes in at a later date you won't see a dime because it wasn't there when they ruled.

Use your credit card and if something like this happens then call them and tell them that you did not receive the item and they have taken the money. I know VISA was more than happy to reverse the charge and take it back from Paypal. Then it's Paypals problem to get the money back from the seller and you can be sure that they get theirs back no matter what...LOL

Why don't you call the police and file a compalint for theft over.

Next...make sure you have a feedback on Ebay to warn others.

Check with other buyers to see if they have contact information as well. It worked for me. I called the guy and told him he had 24 hours or I'd call the police.

You can also file small claims if he is from the same province.

You could also post his name for the rest of us.
