I can't speak to how the law works in Canada, but if this girl has pulled this stunt before she is probably counting on you throwing up your hands and just letting her keep the stuff.

Yes, taking her to court might be expensive and inconvenient for you, but it will also be a hassle for her. If you can afford the time and money I think you should let her know that you are going to pursue every legal remedy possible and use every legal resource at your disposal to get your property back. Give her one last chance to give it all back and then follow through - make it as expensive, troublesome and messy for her as possible.

If you do this right she'll be begging you to take it all back before long.

Been through the ringer with the RCMP. Everything has been reported, but they say this is a 'civil issue' and they can't press criminal charges.

Force the issue. Go to a local JP and lay the charge yourself. Force the cops to look into it.

Does not matter if she is guilty or innocent, the goods will be seized and then you can make a claim on them.

The cops are just being lazy, because the amount stolen is not worth their time.

get all your bills together copy them and try to look up additional reasons for going to court like the above mention metal anguish .stress .loss of income due to work related tools being unlawfully removed i.e. laptop or what every you may need for work to help off set court costs and time away from work

yeah it was her apartment, in her name, and she moved out and took ALL of what little she owned, and then picked through my shit and took as she pleased. I have a witness who watched the moving company she hired take the stuff, and she freely admitted to the cops she has it all. The have it all on record.

#1- How do i get ALL the info in the file from the RCMP, do I just go in and ask for it?

#2- How do I go to the JOP and 'lay charges myself'?

Also, I was going to buy her Jeep from her, and just put $2000 worth of new tires on it. Of course, she's runnin around on these tires as I type this. What can I do about this, seperate, issue? I have the bills for the tires, in my name of course. Can I put a lien on it?

Like I said, she makes good money, and lucky for me I make at least twice what she makes. I have bank record for the past 6 months showing how much money I contributed to the 'household'... makes me sick to even think about how she rode me all this time and then fist fucked me like this...

Did you live in her place rent free? Are there any phone or cable bills documents under your name? For get the tires maybe add them to the list but just try to recover you losses as close to the value possible. If you get 80% back you have done well. If you get anything for metal anguish or losing the ability to work and suport yourself that may off set the tires etc.

File in small claims court. You can recoup up to $10K and no lawyer fees. Get a copy of her statement to the police. You need documentation. Receipts, cc bills, etc. If you didn't keep any paperwork, good luck. You're not entitled to everything. If expenses were shared (even if not 50/50), I doubt you'll get more than half.

Don't you ever watch Judge Judy? This stuff goes on all the time, lol!

Contact a lawyer. Many offer a free intro meeting. He'll probably send you to small claims but you can get a sense of what's involved and what you'll need.

Of course there is a principle involved here, and as I posted earlier I think you should throw the book at this lady and get what's rightly yours.

What I was trying to point out is that you should stick to the items that clearly belonged to you and were provably stolen. if you start in with this kind of crap ("I bought her tires because she said I could buy her Jeep and then she was a meanie and I want my tires back...") you just sound like a petty, jilted boyfriend.

Stick with the clear cut criminality and don't sabotage yourself by trying to go for all the grey areas. Good luck.

I am not sure you can do much other than trying to get your stuff through the cops.

Taking someone to small claims courts I'd consider a waste of time and money, because unless you are able to follow through with "all" the claims even once you win, it'll be years before you see any money. You'd have to be able to locate her and find her bank accounts even if you get a judgement and after that if she wants to hide, you'd get nothing, just a judgement that may ruin her credit rating.

Small Claims Court may not be expensive but it's a waste of time UNLESS you can follow through to the END and beyond. Even if you get a judgement doesn't mean you'll EVER get paid.

It's just a money making business for the government. Going by Ontario courts; first you pay $50 to file, it takes months to go to hearing, Justice of Peace hears you and advises you basically if you have a chance in hell, if you don't like what you hear from the jop than you have to up another $100 if you want the case to be heard infront of a judge, that takes more months (dick meat might be out of the country and making twice as much as her).

Say dick meat wins max 10 or 15 g's!!! Now you gots to get your money, right? You have to find where the girl banks. Great now you have to put out more money to file motions to garnish her bank account, that's if you find it, or already put out other moneys to serve her all the papers, and meantime you don't even know where she is..... ok I'll stop rambling now.....years have gone by and you are not angry anymore and you are wonderig why you've wasted all this time....you get my drift

Take her to smal claims and if she does not pay you back ruin her credit and her name. Take out and ad in the local paper... if the police know she has the stuff and took it is not slander... but her picture up.
But in all honesty... have her dealt with.

I think he should if anything consult a lawyer first. A lawyer will be able to tell you what your real rights are. He can also advise as to what different options he has to do to get the police involved and to recover his stuff. He may not need one to goto court but you would be foolish not to consult one first.

Rather than listen to a bunch a wannabe lawyers Its better to consult with a real lawyer and get the real facts. He might know things that you can do that only lawyers would know. He might know exactly what you can do or say to totally turn the tables on this girl.

A short meeting with a lawyer can save you alot of time and headache. Who wants to spend days trying to educate yourself on what your rights are.. Thats what a lawyer is for and if he is a good lawyer he will have real working knowledge from being in the field.

Another option which I find also works is to hire a credit recovery company. The company I use will collect on personal debts and you don't have to prove to them how she owes you the money. They can also damage her credit if she doesn't pay. Alot of times the fear of your credit being ruined is enough to make you pay.

The only catch is that if they recover any money, they take one third. But the headaches she will get from the creditors calling her consistently for your money might be worth it.
