To all the legal beagles,

Does anyone know how many weeks of vacation an employee is entitled to receive after nine years of employment? I have been trying to look up an answer without much success. It is a non-union position.

I believe that most companies offer anywhere from 3 to 4 weeks but it depends on the company. Where I am employed it is a non-union shop (everyone is on salary including plant employees) we get 3 weeks after 5 years and 4 weeks after 10. Again, every company is different and I'm not sure that there are any regulations that indicate a minimum a company must give (unlike severance).

Yes. The answer is two weeks.

Legally, an employer is not required to offer additional vacation time to long-serving employees. This is often done as an incentive and reward to loyal staff but is at the employer's option.

Also, some contracts (union or otherwise) may specify a vacation formula.

Absent an established company policy or pre-existing contract, you need only provide the legal minimum of two weeks.

That's the law. As for what's right...

Another Question re: Vaction Pay

I also have a question re vacation. Maybe someone can answer and I won't have to read all that info in link above to try and figure it out.

I always thought one was entitled to 4% pay if you do not take 2 weeks off. At my work they say we MUST take the two weeks off. If we opt not to take the time off then we loose out. They refuse to pay the 4%. They say if we do not take the time off then we get nothing. Is this legal?

Thanks in advance for any input.

You can forfeit your vacation time and opt for payment as long as your employer agrees in writing and has the approval of the Director of Employment Standards.

Thus, if your employer refuses to forfeit your vacation time, then you're SOL.

Vacations serve a couple of purposes:

1. They provide an opportunity for an employee to have a "Break" from work for mental & physical reasons.

2. It is a control tool that management uses. When someone else covers your duties, it allows them to uncover any inefficient work practices/habits you may be following.

3. It gives them a break from employees who are a pain in the ass - LOL.
