As PM his first responsibility is to ensure the safety of Canadians, communication with CSIS / RCMP & Boarder security would be job 1
Trudeau did mention the offer of condolence and resources to the US. this is also extremely important, however it appeared to be a secondary thought for JT

Pontificated about the "Root cause" when it comes to nut jobs who target & murder civilians is a waste of time & defiantly not a priority at this point

Don't you think understanding the root of this may lead to understanding how these kids were radicalized, who may have filled them with hate and who else in their circle may be a threat? By all accounts the younger son was not isolated and most people who know them did not think they were loonies, so you are just spewing nonsense ... did you blow a load because you think Trudeau failed? Did you get a chubby? lol and how did Harper not fail here? Ultimately no one passed the test because the bombers succeeded in their attack. Don't you think we should try and find out why? The older son was already on LE radar so how was he not picked up? Root causes are not just the emotional and psychological causes, but failures within law enforcement and intelligence to prevent this act of terror.

So what if a visitor to the US committed an offence and was apprehended?
How would that play out?
There is currently an argument as to whether someone like this should be treated as an "Enemy Combatant." However, place money on this being handled through the regular criminal justice system.

Assuming that it is handled through the normal criminal justice process in most ways non-nationals are treated as are nationals. Differences in treatment are mostly in the area of immigration and administrative law.

Of the interesting things I leaned from the coverage is the Miranda warning isn't mandatory; if it isn't given the suspects comments can't be used in court but any other evidence still holds.

(of course assuming that the CNN guests weren't speaking out of their collective ass)

Interesting article on CNBC. He will be held under some special security clause where he has no Miranda rights, no right to an attorney and everything he says is admissable in court. He is to be interrogated by a special force of FBI, CIA, and Military Intelligance types. No death penalty in the state of Mass. but they can arrange to go to some kind of Federal law overriding that. Wouldn't want to be in his shoes, as soon as the doctors release him he's in for a major shitkicking.

Nope, what they said is the case.


The other one people frequently get confused about is the police don't "read Miranda," they also don't ask any questions, person under arrest starts talking. Everything they say can be entered into evidence the "Miranda Warning" only applies to custodial interrogation.

Under the Public Safety Exception, the types of questions that can be asked are as the name implies limited to public safety e.g. do you have bombs in other places, are there explosives in your mother's house etc. . . but not why did you do it?

Further, the sole "punishment" for violation of a subjects "Miranda rights" is that statements they have made can not be entered into evidence. In this case is there any TERBite who does not believe that there is more than enough evidence to convict without a confession?

Given that, it may be felt that it is more important to learn what Dzhokhar Tsarnaev knows than to use his statements as evidence against him.

As I understand it, they had both legally immigrated to the US and had attained citizenship, can they be stripped of that status? I would assume if the US gave them citizenship they can also take it away?
Jessica in both the U.S. and Canada without trying to find weird exceptions that applies to lies told to gain nationality. Not to being just plain dirty rotten scoundrels.

They had both entered the U.S. as refugees and had become naturalized citizens.

I think it was the younger one along with his parents who came to the U.S.
first as visitors and then gained the refugee status. The older one came
at a later time and got the green card but I could be wrong about this.
Interesting their father returned to the country they fled from after they
settled down. But I guess that is what makes our refugee system more
advantageous than legal immigration.

You mean other than the video of him planting the bomb? (not intended to be super sarcastic)

I suspect that we will find that the older brother played the role of Svengali to Dzhokhar, that, however, doesn't make him any less guilty. It really is tragic he apparently had a life of bright promise ahead of him which he willingly threw away.

I saw that interview Justin Trudeau did with Peter Mansbridge.
Mansbridge asked how Trudeau as PM would respond in such a situation.

As you indicated, his answer focused on "why they feel alienated from society" ???

I would prefer a leader who's first thought were to ensure there was not a more wide spread threat and do what is required to protect Canadian lives
He is not ready for the top job, nor do I think he will ever be.
I didn't watch that interview, and not to defend Justin Trudeau, but even Obama implied that the investigation should look into why an Americanized immigrant who's educated in the USA would do such a heinous act. How do they get indoctrinated with extremist views?

The threat cannot be neutralized by force as has been demonstrated time and time again. The fact that Canadians were involved in the attack on the Algerian gas plant should be resulting in a much deeper attempt to understand how these people become radicalized. The Canadian cell that attacked in Algeria could very easily have attacked Canada. By not making the effort to understand the root causes we are simply spending money on ineffective measures. That is the reality. What has Harper done since revelations that Canadians were involved in the Algerian attack? If Canada develops a reputation as a source of terrorism, it will be extremely detrimental to our country and our personal freedom. JT has worked as a teacher, so he probably has a much greater understanding of young minds then you or me and has probably observed the affects of isolation quite closely.

Don't know if this has been posted already, apparently the younger brother may have inadvertently killed his older brother by running over him with the stolen car in an attempt to scare off the police as they were trying to hand cuff him. The older brother was dragged underneath the car for a fair distance.

Likely entirely admissible. If Constable Duright starts asking you questions on the way to the jail (without advising you of your Constitutional rights) inadmissible. On the other hand, Constable Duright is quietly driving you to the jail and you say "since you haven't read me my rights, you stupid cop, let me tell you what we did XYZ. . ." every single word you say is admissible at trial.
