if they are partially or in full funded by Federal or states they have to practice equal opportunity law, the same in Canada...

There are a lot of private universities in the U.S. The Michigan situation was I believe contested in court and the courts, if I remember correctly, said that universities cannot admit a lesser qualified candidate over a qualified candidate to meet a quota but I think the Michigan universities then changed the admission standards to include "intangibles" (open to interpretation).

Just did a quick Google of University of Michigan. Apparently, the U.S. Supreme Court ruled in 2003 that a university can take race into consideration when admitting students to meet "affirmative action" and "diversity" objectives. This means that applicants of a particular race will be automatically awarded 20 points (sort like handicapping in golf). Otherwise, it would be unfair for those applicants to compete on a "level playing" field with applicants of other races.

It is because people have all sort of biases, even though they might not show it..but they do passively practice it whenever they feel safe, that the chance of getting into trouble is minimal ..

they look at your name, they guess if you are a Jew or Muslim...they look at the year you graduated from college, they guess if you are too old for job...things like that.. they see it on your resume, on your university application...
