Harper is the first PM to have judges appointed whose very fitness to sit is quesetioned.Oh pleeeeze. Name me a head of Government who doesn't make partisan appointments.
Section 6 of the SCC Act states 6. At least three of the judges shall be appointed from among the judges of the Court of Appeal or of the Superior Court of the Province of Quebec or from among the advocates of that Province. Questionable experience aside Harper didn't even see fit to do that. Ontario AG is also an intervenor arguing that Nadon doesn't meet the criteria to sit on the bench because changes to the SCC Act require a constitutional amendment and provincial consent which the Conservatives are unwilling to pursue instead slipping in amendments in their omnibus budget bill last year.
