The police generally will charge the homeowner in these situations knowing full well that likely the charges will be dropped.

I wish they wouldn't even do that, but in any case its not as bad as it looks.

Better to be tried by 12 than carried by 6 is my motto.

And BTW, if it was a 14 year old, a 12 year old, whatever, what does that have to do with it?

Someone is threatening to K I L L me, so, I should take an INCREASED risk because of their age?

No can-do.

They also steal cars on the underground parkings...my friends daughter's brand new mustang was stolen there...she was also reckless and sometimes forget to lock her car.

luckily I genuinely don't look at her that way and saw her grew up and really close friend my wife always tease her that she looks like Ashley Tisdale...don't know who that is.

There is a good chance that someone who breaks in could be more violent or have dangerous weapons to ensure you don't fight back

a - you're obv not a gun owner with those remarks, people don't get shot for forgetting their car keys

b - being afraid the intruder may have more dangerous weapons is a reality

c - in imminent danger, violence is often the only answer if you dont have someting to defend yourself with you will d i e

As to teh specifics of this, and similar cases.

First. It has been my experience that even if you are the victim of an aggressor and you so much as push him back and he looses his balance falls down, hits his head on a lamp post or sidewalk and is knocked out or bleeding, the cop IS going to charge YOU with assault. Last man standing, especially if they are bigger physically, seems to get charged..no matter what.

In this case, reading between the lines... I wouldn't be surprised that once the homeowner saw.heard/confronted the intruder, he laid a real beating on the intruder. And he opened his mouth using lines like the tough-guy TERBites here have said like "Yeah, well he had it coming and he's lucky he didn'tget carried out in a body bag etc. Or some other words or actions that the homeowner/initial victiim decided to "teach him a lesson" or even saying he knew this guy and was pissed off and angry. Even having a baseball bat at yor front door if you don't play baseball shows your pre-meditated intention to use it as a weapon. Same with having a knife beside your bed. Or a baseball bat in 9our car when you don't play baseball.

Carrying a knife on your person is not illegal so long as your stated intention is to use it to cut twine, boxes or whatever. Once you say, or add, 'and just in case I get attacked I can defend myself', well then that makes it a prohibited weapon. If you happen to use it to defend yourself

Mens rea, aka guilty mind or intent makes all the difference.

If the guy had have said something like; "Well the guy came in and I yelled for him to leave, he didn't and came at me.. and I punched, kicked or pushed him down the stairs to defend myself... and that he got back up and kept coming at me... so I feared for my safety, and life that he may be on a PCP or otherwise mentally invulnerable to simple defense, so I hit him with whatever was close, (fire poker, whatever happened to be near) until he stopped moving SO THAT HE WAS NO LONGER A THREAT to me or my family", than he may very well not have been charged in the first place.

But if Bubba had have said' Yeah, I told the motha fucka to GTFO and he didn't so I taught himself some manners, or that he had a baseball bat beside his bed or front door and wnet looking for the guy and hit a home run as he came around the corner and hit a triple off his face, or worse, the back of his skull, .... well then he's gonna get convicted too.

you know that line about - "Anything you say can and will be used against you in a court of law" understand that as: before arrest shut the f up, trying to explain anything to a cop is them assessing whether to arrest you or not, and if you are arrested put a cork in it and only talk to your legal rep.

First, what I meant by that is that there are stories of teenagers sneaking into their homes and being shot by a parent who thought they were being burgled.

Second, gun owners in Canada have requirements to store their weapons in a safe and unloaded. So, if you were a responsible gun owner, you likely wouldn't have a chance to get your firearm quickly.

The point I was making about the intruder being armed....If they think you might be armed, they are going to come armed as well, when they might have not in the past. And, I would love to see statistical data showing that areas with high guns have less crime. There is no evidence this is the case. So, the reality is that guns could make things worse, since a thief might bring a gun just in case...

The point is you should be allowed to defend your home, auto, person, family with lethal force if necessary and not be arrested for it when its clearly not you instigating it. You can be afraid the criminal will be bigger, badder and armed- but that's also the point - they are bigger and badder and armed.

Lets say you are up stairs in bed at 3am and you are awoken by a window on your lower floor being smashed. In less than 60 seconds the intruder will be upstairs in your room with you awake. At a minimum he's armed with a knife. What do YOU do?

a - Call 911?
b - scream (who is going to hear you?)
c - pretend you are sleeping? and let fate decide
d - fight back, kicking the intruder down the stairs, where he happens to break his neck in the process and is now quadriplegic
e - fight back, using the bedside lamp, fracturing the intruders skull, and who is now mentally incapacitated for life
f - take the assault like a big boy?

Actually I will probably donate more but this month I have had a lot of hands outstretched toward me.
Friggin insane that the victim. And I mean the guy who got his apartment broken into is being charged with anything. Should be a case of all bets are off once you do that. But this is Canada. I hear the UK is worse at this point.

You can laugh all you want. I was just stating the law. Some criminals you can scare out if the house just by yelling and if that is all it takes, that is all you are allowed to do. Period.
This is the stupid thought process that we sadly have to put up with.

A criminal enters your house. All you are allowed is this so-called proportional response. So the intruder walks toward you aggressively after you discover him. What are you allowed to do? Walk toward him? You have to wait until he ties to kill you before you can kill him? You have to wait until an attempt is made to stab you before you can use lethal force?

If somebody breaks into your house, day or night it is a nightmare come to life. The intruder has crossed the line into the world of the bizarre. Since they have no apparent boundaries and you have no idea how bad they can go, killing them at that point seems like a reasonable response.

pointing a deadly weapon to a cop is a big no no. it is also a big no no pointing it to a civilian who is also armed...charges are not convictions...intruder gets a beating, homeowner gets a charge because it's a standard procedure, once the courts see the situation...it always comes down to..."when you shouldn't be in the area, you wouldn't get beaten"
