They weren't obligated to before the Mint stopped issuing pennies. They can specify what cash they will take in transactions. That's why businesses can refuse to take $100 bills.I've seen some places stop accepting pennies too. Say paying with 5 pennies instead of a nickel. There's no hard and fast rule on it; some continue to accept them as good customer service, but apparently they are not obligated to.
