Speeding ticket question

Hey all,

So I got a speeding ticket today and the officer wrong the incorrect date on the ticket.

What should i do? Does it render it void? Do i show up and say i want a trial and show the wrong date?

The ticket is dated for tmrw..the only way I can think to prove that the date is incorrect is by showing up before the date and time on the ticket.

I doubt a snapshot of it on my phone would hold up in any court.
i cannot afford any ticket or points...any suggestions..

I believe that is an amendable offence on the officers part and is still prosecutable...What I would recommend is to book a court date, at the same time request disclosure. When the court date comes, if the officer does not show up then it is automatically dropped anyway. Also if the disclosure does not come, then you should re request the disclosure prior to the court date. If it still does not come then that can be communicated to the justice of the peace who will decide to change the court date, drop the charge, or to re request disclosure at the time. In any case book a court date is the first step.

I believe they can amend the ticket in court for such things. But really all they have to ask you is two questions: what day did the officer hand you the ticket? And was that the same day that the officer stopped you for the infraction?

I could be wrong but a quick search on the net seems to show the majority of opinions/cases say you won't likely get off on this technicality. But YMMV.

I would say you take a picture of the ticket...with A RECOGNIZED CLOCK CALENDER IN THE SAME PIC.


TAKE IT TO TRIAL..LET HIM TESTIFY TO THE WRONG DATE. SAY NOTHING. I THINK HE IS ALLOWED TO CORRECT THE DATE....but he has to correct the date when he testifies.


in the meantime, you need an alibi for the time on the ticket...be out of town..anywhere...that provides an alibi.


then when he testifies wrongly....BAM...u got him.


alternatively...u could just pay the ticket

do something tomorrow where it witnessed by several people...
receipts and whatever.....ask for a court date...
then produce the evidence to prove that there was NO WAY you could have been in the location to get the ticket where the ticket says you were....

so i will take it to court..i took a pic with CP24's date and time in the background...i'll go do some stuff tmrw around the time of the ticket just to cover my ass...hopefully the cop just doesnt show...

I agree with you..but i have no kids, nieces or nephews..nor any friends with kids..i had no idea school started

I read on the elevator tv at work that there was mass blitzing around school zones...sigh..too late

So the ticket is dated Sept 4th. You might think it would be a smart thing if you were to actually spend the day of Sept 4th in Niagara Falls, accompanied by several friends. Then you go to court armed with an unshakeable alibi, by which you will prove that you could not have committed the offence you've been ticketed for.

You do not have to "tell your story" or disclose your defence, to anyone, prior to trial. (The prosecution have to show you all the evidence they have, though you might have to ask for it.) So you don't say a word in any of the pre-trial contacts.

You turn up at trial. The prosecution presents the evidence of the crime, including the date of sept 4th.

You introduce your four witnesses who will prove that you were out of town all day sept 4th.

The prosecution moves to amend the ticket information.

You object to the motion, on the ground that you have put a lot of work into your defence. You credited the police and the prosecution with being halfway competent. Not your job to cater for mistakes by the authorities. You assumed you had to defend yourself against a crime that took place sept 4th. You've brought all your witnesses to court on that basis. You haven't had chance to prepare any defence at all for sept 3rd, and in fact you cannot now remember what you were doing that day. Huge inconvenience to you if the trial is now postponed to allow you to prepare a defence for sept 3rd. Huge injustice if the amendment is allowed. The prosecution cannot be allowed to play fast and loose with the facts of the case, blah, blah. I demand that you disallow the motion, your honour..

I was going to say, Don't do that. But on second thoughts, yes, go for it! I'd love to see how it would work out.

The police officer or who ever enters the ticket into the tracking system may have caught the error and entered the correct date.
Remember, the ticket can be paid online or by phone so it must be entered into some database.

Don't speed. Follow the rules of the road and you won't need to pay. Its a voluntary tax and by speeding you volunteered to pay it.

Doesn't void the ticket. Some of the advice here involves borderline perjury, follow it at your own discretion. You can say you weren't around on the date in question, but at some point someone will ask you what date the officer handed you the ticket. Suddenly all your posturing and semantic dancing with fancy pictures mean nothing. If you have an expensive lawyer, you could maybe dissect the officer's notebook, but you'd also need a longer trial involving you filing the proper discovery, blah blah blah.

Trust me when I say that whoever is prosecuting and whoever the cop is have had this happen before unless they're both new. You won't trick them so easily. True, the cop may not show. You also might be able to plead to something lower. I think both of those are better than trying to fool the courts. Judges don't generally appreciate that.

Agreed, refer to my response above...by the way I have had a officer spell my name incorrectly and it was full prosecution, but because I had disclosure I uncovered the radar gun was not calibrated properly prior to my stop...I referenced my 407 bill to show time of exit north of the 400 vs the time the calibration of the radar gun was done...

Before you lie to the court about being out of town on that date, please answer these questions.

1. How many KPH over was your last ticket issued for?
2. What's the total number of HTA tickets/convictions you've had in the last 3 years?
3. What's the total number of points you've lost in the last two years?

To determine the number of tickets you've had/points lost in a specific amount of time, use the date the tickets were issued, not the date of conviction.

Did YOU not go to school yourself? Don't use that bullshit excuse as it will destroy your own credibility no matter what alibi or reasonable argument you may pose. If it wasn't a school zone you were caught in, then it won't be so bad.
