Speeding Ticket

I get caught at the exact same spot....during rush hour.

Now let me first say that speeding is speeding...I broke the law and should pay the penalty...

HOWEVER!!!!

The very thought that our police administrators would put a speed trap on the only road that's moving at the peak of rush hour is poor form. I don't care what anyone says...let's keep the lanes that are actually moving...well...MOVING!!!

It's such a scam when I see so many instances of truly dangerous driving everday on the 400 series...my personal faves are Johhny Tailgater (no matter WHAT lane you're in) who loves to live out his redneck Nascar fantasies behind a van full of kids in the RIGHT lane....and it's even better when Johhny's at the wheel of a Semi....

Or how about 18 year old Ricky Ricer...you know...the one that weaves his moms pimped out Honda civic dangerously in and out of traffic...just missing bumpers...crossing multiple lanes. He figures he's seen enough movies and played enough video games that he qualifies as a real racer....when actually he's just a punk who'll probably not hurt himself but will take out someone else....

No cops around then is there???

Luckily I sleep better at night knowing they put a stop my dangerous habit of following the flow of traffic (within reason) so as to keep things moving during rush hour....what a fool I was...yeesch.

It's like sending Martha to Jail while Osama enjoys a life of freedom...

Good job Toronto Police...keep up the stellar work...

If you got the time, take the tip.

She paused and said that I had the right to challenge it and plead Not Guilty. If I was to do this I had a 50-50 chance of her showing up in court. "You never know she said". ..
My question is:

What is everyone's experience with pleading Not Guilty and going to court?

Do you think she was "tipping" me off? I have never had a police officer say "you never know" to me before!

I would appreciate your feedback.

Champ
Her way of saying she doesn't agree with her assignment to babysit the Lakeshore for minor speeding offence. There is always one there from Sunnyside pool and around Boul. club near the bends. As stupid accidents happens there all the time. Not to mention dumb U-turns, etc.

She's telling you she doesn't agree with the ticket but has a quota to meet. Take the hint. Let's just say I know. She's doesn't want to go to court thus 50-50 even though she paid to. If her supervisor force her to, you can plead guilt get reduced fine.

K Douglas and Stange1 are correct. Reschedule more than once really mess the traffic cop's schedule, thus no show. French court also works but you or your representive better be fluent.

WhOiSyOdAdDy?

imagine a place where moving violations do not affect your insurance rates.

In BC, only claims affect your insurance rates.. someone could get stopped for impaired driving and unless they hit someone or something, it would not affect their rates

Now that would be nice. I believe in BC the insurance is provincial, rather than private. A while back that very same idea was suggested for Ontario. But somone obviously stuck some C-bills in someone's pocket and that idea was never heard of again.

She might be giving you a good hint.
I once got a ticket and as the guy handed it to me, he told me to take it to court.
So I did and when I got there the prosecutor said it's your lucky day, we've lost the evidence.

Here is a proven way to beat these traffic infractions more often than not.

1) Line up in person and request to file a court date for the infraction
2) You will receive a notice in the mail of the court date (6-9 months away)
3) A couple of weeks before your court date, go in again and request to file a motion to move the court date to a sooner date (just say you will be out out of town)
4) Attend the sooner court date in person to advise the court as to why you can't make the original court date.....they will be assigned a new court date (1-2 months out).....request a night court if possible
5) Attend the rescheduled court date...chances are the cop doesn't show and you win.

You NEVER go to the original court date (6-9 months away) because the courts ensure the cop has several infractions on that same day...thus, if they show up, you lose.

When you go to your rescheduled court date (1-2 months after the original court date), there is not enough time for your cop to have amalgamated enough infractions by that date to be worth his/her while to show up on your court date. Chances are, you will be his/her only case and they don't show up.

Good site

A lot of good advice here.

I've been lucky. Recently I got two tickets - one for failing to stop and the other for doing 85 in a 50. In both cases I pleaded not guilty. The 'fail to stop' officer didn't submit his end of the ticket so it didn't go further. For the '85 in a 50' I received a letter 6 months later stating that they weren't going to pursue it (interestingly, there was a footnote that showed the file path with a directory named 'backlog' as in 'backlog of tickets we won't pursue').

This site has a lot of the above tactics and more, including your right to a speedy trial...

Plead not guilty in all cases for the insurance reasons alone!

That's because most of the Insurrance company have their head office in Toronto, and they are close by and put a lot of pressure to Queen's Park to keep the system in Ontario as it is.Lots of money for their Company and at election times they pay a lot to keep them (MP's)reelected

My 2 cents anyway

Update

Ok Guys, here's an update.

I recived my notice to attend court. It will be this July 26th.

Please clarify if I have this wrong:

NEXT STEPS:

1) Go in to the office on the back of the ticket the last week of June.
2) Ask for a new court date due the fact that I have a pressing business meeting that I must attend. Question: Won't they ask for a note from my Company?
3) Ask for Night Court.
4) Ask for a date in the near future. Hoping it is several weeks after the original date.

Anything wrong here?

Anything else I need to know?

Thanks!

Champ

Unless rules have change:
2) won't need note to reschedule court date. Up to 2 reschedules. When attending court, be prepare to back up your facts. Some Judge don't tolerate BS.
3) If you can speak French, ask for trial in French. Night court are very busy as most work during day. Won't improve your chances.
