Section 122 gives the president the power to levy tariffs up to 15% to address BALANCE OF PAYMENT problem not trade deficit. China and all those countries creating trade deficits turn around and purchase US treasuries. So the balance of payment is zero.
Since there is no balance of payment problem, the new tariff is also illegal. It would have expired by the time courts issue a ruling. But those paying the new tariff will be due refunds when courts rule in their favour eventually.
By the way, FedEx has launched the first court salvo to claw back payments they made under the illegal IEEPA. Thousands are due to follow. Lawyers are salivating

Thanks to the SCOTUS, the worst Trump can do now is a 15% tariff which expires in 150 days. So Canada must not allow permanent tariff to be a part of any new deal. We should stand firm. No deal is better than a bad deal
