The new charges in the Northern District of California are are nine counts of wire fraud and two counts of conspiracy to commit wire fraud.
The United States alleges that Holmes and her partner Balwani knew that their mini analyzer (TPSU) did not work properly but they still deliberately mislead potential investors by staging false demonstrations of the machine.
We shall see if there is a conviction and if so what sentence is handed down but she is looking at a maximum of 20 years imprisonment plus a fine of $250,000, for each charge (now of course the actual sentence will be much less than that).
You combine this with her previous plea agreement and it certainly does not seem like she "got away with it."
