From an article in the Toronto Star yesterday, the contents of the computer were excluded because although police had a search warrant for the residence and its contents they did not have a separate search warrant for the computer (which it is my understanding had not previously been required in Ontario).

I fully understand this. Just pointing out that if he appealed that he'd be convicted faster because of the additional knowledge the jury will have. He won't get an untainted jury that doesn't have previously suppressed facts.
Can the fact he would not get a fair trial let him free - IF they happened to order a new one?

It was not required until some "judge", of what I don't know, decided recently, IN HIS judgement, that a computer is now, NOT an object, but a "place", because so much can be "stored" in it.

Again, asking for some legal input on this.

An article in the Saturday Toronto Star said that this bastard was quite a ladies man. Wonder if he is getting 5,000 letters (many with nude photos) from female admirers like Bernardo, Scott Peterson, Ted Bundy (who actually married one of these women), etc.?

There is nothing redeeming about this Rafferty guy and what he did was low, disgusting and down right sick.

I'm pleased that he is going to jail and hopefully serving a long term.

Whether he is killed or raped in prison is not something that I'd wish upon someone even scum like him. I find it strange that people fantasize about how Marque De Sade they would go on his virgin ass.

It's more expensive to execute them. Unless you want to compromise, somewhere, on making sure that you really, really, really are executing the right guy. There are too many cases of guys serving life in prison for murder turning out to have been innocent after all, or at least, only guilty of some lesser crime. In order to validate that you aren't executing someone like that it takes a very lengthy, and very expensive appeals process. It turns out to be cheaper just to throw them in prison for life.

In such a context the death penalty appears to have virtually no deterrent effect. The problem is that the length of time between the crime, and the execution, is so long that its deterrent effect is nullified. If we could somehow instantly know that a guy was really guilty and execute him on the spot THAT would likely have some deterrence, but executing someone 15 or 20 years later--maybe, only if they lose all their many appeals--not much of a deterrence. On the other hand, without that legal process, quite a significant risk that sooner or later you will execute an innocent man.

I also am a little disappointed (but not surprised, unfortunately) that you never responded to my wager post or never admitted you were wrong about the verdict. It's a shame because if you had taken me up on my wager, you wouldn't have posted more drivel like the post I quoted

Unlike with the death penalty I don't seem to recall too many people with the fantasy of raping dudes like that, or for that matter watching if some other scumbag would take one for the team and do the job. For that matter even with death and other forms of torture, I'd guess most people would prefer some other guy do the nasty in reality. I eat meat, but praise Xenu that others are willing to work at Bovine university to help all those cows graduate.

Read in the papers that keeping this monster in jail will cost taxpayers $114,000 (plus inflation) annually. His trial and appeal (if there is one) is funded by legal aid, also at taxpayer expense. That means he and his partner in crime are costing the taxpayers over $225,000 annually. At least his partner "woman up" and spared us a trial (same with Russel Williams)..

Somewhat along those lines - I always thought Site 415 would make a great place for a prison. No need for guards - fly in the food once a week. Let the inmates sort it all out.

You missed my point. It had nothing to do with other people doing the deed on Rafferty.

I just find it interesting the kind of thoughts that go through "regular" people's head. Right or wrong whatever. Guess that's why stonings, lynchings and executions draw a crowd.

Heck kids will stand and watch a fight. To some degree or another everyone has a certain amount of interest in violence.

Fire ant man up above has some pretty twisted ideas. That's just fucked up. Prison or death penalty fine but all that Hostel/Torture porn stuff is just over the top.
