A: Because she didn't report the incident to police. Her mother's boyfriend complained on her behalf.
Q: Why didn't London police file charges in 2018?
A: Among other things, video of E.M. leaving the hotel, (see post #311), led detective Steve Newton to conclude that she was not sufficiently intoxicated that she would have been unable to consent. Newton did not believe that there was sufficient evidence to file charges. Since there was video evidence that consent was given, (in E. M.'s own words), the Crown would have needed to prove that E.M. was incapable of offering consent, and there is only her unsupported testimony to make that argument.
Q: Why was the case reopened years later?
A: Because there was a big stink on social media after reports about the out-of-court settlement were published.
