If all of them were held in custody, crime statistics would decrease, and we would have more police officers than we would need. Cops would need to pursue petty crimes, where the cost of prosecuting would far outweigh the small fines imposed if the perpetrators are convicted.
Canada doesn't have the infrastructure to lock up all criminals at will. Harper wanted to build Superprisons, they have become money pits to the jurisdictions that have them.
