Usually they hand out their cards and tell attendees to call them for other properties if the current property isn't what they were looking for.

well basically what happened here my friend is selling a house to buy another one and the agent decided to do an open house and then when back noticed that the newspaper that she left the person wrote different house prices for diferent houses on it. So obviously she was offering other houses while having an open house at her house. So she wants to break a contract with her agent. Is it legal for an agent to do and terminate the contract

An open house is held by an agent so that they can capture purchasers for your house, or any other house. Most likely any other house. They would like to sell your house, but with so many houses on the market, the chances are against that happening. You can’t break a contract because the agent was giving potential purchasers information on different properties. Anyway, that is one of the reasons you don’t see the owner of the home around during an open house.

The agent in the open house may not even be the listing agent for the house. May not even be with the same company. Same goes for print advertising.

Also tell your friend that the next weekend at another open house the agent will be offering your friends house up if the visitors don't like or can't afford the house he is featuring that day. Sounds like you friend is looking for a reason to cancel his listing - but the agent is working hard for him and will find a buyer for the house- remember - the agent only gets paid when the house is sold, so it is in his/her best interest to find a buyer for your friend.

I don't see anything wrong with an Agent marketing your property and if a potential buyer does not like the subject property, to offer him/her an alternative.

Ever think about when the Agent is at another open house - the same thing might occur and your property might be the one marketed.

Well what my dad does, is he hands out his card, and let them call him wiht thier questions or list of houses they would like to see.

when he is not driving TTC, or doing peoples taxes he is selling houses. at one point I thought I could be a real estate agent.... well that is not going to happen I am going to school to become a midwife.

For goodness sake, did the agent break the contract? Under what grounds could the "vendor" break the contract? The contract (listing agreement) doesn't say that if the agent does an open house only the house listed would be discussed at the open house. You're friend (and you) must be VERY inexperenced in business and in real estate transactions.

Most agents view open houses as a way to gain NEW clients.

Sure, they are showing your house, but people are coming in who may just be THINKING about buying or selling. That's what the agents are after - the next commission.

They've already signed YOU up and eventually, they will sell / dump off your house and away they go.

It's the next guy they want.

100% correct. The majority of the time another agent sells the home and that is why listing in the MLS is so important. As far as open houses, nosy neighbors and Sunday drivers are the norm.

thanks my friend now regrets having an open house since it seems like a waste of time! Also if she switched the agent what is the qualities to look for when looking for an agent? Thanks

A hot babe would be a big asset, at least for me!! All kidding aside, the agent you pick should have familiarity with the area, be professional - not only in speaking but appearance as well - and the biggest quality should be the ability to follow through. Too many agents do not have the tenacity to follow through with prospect and that is what separates the good from the bad in that business.

Your friend's agent (seller's agent) has a fiduciary responsibility to your friend to sell her house at the highest price she can get for it.

However, just because it doesn't sell for the originally listed price, or the agent presents a list of properties she represents to buyers agents and potential buyers doesn't mean that he/she isn't fulfilling their fiduciary responsibility.
