Past behaviour can’t influence what happened in that particular instance. Otherwise you’re opening up so much more to be including if they want to be doing character judgements which have so many more bias with regards to the jury It needs to remain about the facts of that situation
That's the overall theory and why the evidence isn't routinely allowed before the court

Now you know why London Police didn’t charge after the first investigation…never knew about any texts including McLeods inviting players to a 3-way, only interviewed 4 out of 10 players, apparently believed the players stories…never looked at bar video, obtained EMs clothing but did not do anything with it, did not obtain warrants to obtain Hockey Canada investigation information…doesn’t sound like a very thorough job was done by the London Police.

Hypothesizing that the police knew about those texts, what charges would police have laid based on that?

-the cops aren’t going to “talk” to the players about being “bad boys”, this is not kindergarten and that is not their job

-she can’t press charges no citizen can…she makes a complaint and the police/crown decides if charges are made

You listen to the players speaking to Newton and throw in Howden’s trial testimony and it’s not even close to the same.

And yes, with the girls testimony it’s hard to believe that these people are taking about the same incident

Well, you can't disagree with that I mean, EM's gotta be the person talking to him, not her mother

How about the cop's position to decide if she was too intoxicated to consent by watching the video her arriving and leaving the Delta I mean, he did it on a videotape... I guess she had to be fallen down drunk and being helped by two other people how would you be able to tell that she was intoxicated? This cop did a bad job

The Law does not owe satisfaction to the boyfriend of the mother of a possible victim of crime who chose not to approach the police department of her own volition.

Of course they wouldn’t release it but I think they could have subpoenaed for it, it was a serious crime investigation

I guess it goes more to Hockey Canada’s attempt to bury it

The bar video might have showed how much she was drinking and how everyone was behaving, he didn’t even look at it!

Walking thru a lobby showed him how drunk she was? Not going to accuse this cop of over investigating.

And he says she was consenting because the players say so? Might as well had the players lawyers do the investigation

Do you think her decision to go ahead with charges had anything to do with McLeod tracking her down on Instagram , then messaging her not to get police involved, tell them it was a mistake
Maybe she was worried to go up against these Canadian hockey heroes , soon to be NHL players
And sounds like she was right ...Newton didn't investigate the players till 6 months later because of their "busy" schedules, and then at their lawyers' office.
Do you think a group of 'regular' guys would get these privileges ?

He didn't even bother to interview any other players who were in the room as possible witnesses ?

It's entirely possible that Fun For All's theory of what happened that night is 100% true. That doesn't matter.

There isn't sufficient evidence that his beliefs are truths. Criminal Court verdicts are not based on beliefs, or sympathy, or any emotional reaction to any witness' testimony or counsel's tactics. Those things only matter in Civil Court proceedings.

There IS video evidence that E.M. consented to all of the acts that evening. There is no evidence that she was too intoxicated to be able to consent.

There IS video evidence that she was sufficiently sober to exit the hotel in heels without difficulty. Nothing prevented E.M from going straight from the hotel to a police barn in the early morning of June 19, 2018 to file a complaint. Texting her friends appears to have been a higher priority to her.

They won't press the charges if the complainant is not on board and they need to rely on her testimony to have a reasonable chance at prosecution. There was no physical evidence of sexual assault. There was no videotaped evidence of sexual assault. There was no eyewitness testimony to corroborate her recount of events.
Crown has rested it's case...I don't see enough evidence to convict here. Not even close.
