As a Canadian in Canada the 5th Amendment to the United States Constitution does not apply to him and isn't really valid in Canadian court. Another thought, maybe it is a good idea to get in the habit of checking your licence card every year on your birthday - or maybe some other arbitrary date like New Years or during your Bi-Annual Daylight Saving Time Clock Switching because if you only check on your birthday it will be too late...especially if your birthday falls on a Saturday or Sunday (or any Holiday)!
As well according to the Ministry of Transportation website you can even get it renewed 180 days in advance of its expiry if you are not going to be in Ontario...but it doesnt say anything about proving it...so maybe get into the habit of checking your licence on a good friend's/family member's/significant other's birthday that falls a couple months before yours so you can go in and renew in plenty of time. Everyone complains about local charges at the municipal level. Yet I hear no one complaining about the tax cuts they are receiving at the provincial and federal level, about the reduction in transfer payments to the municipalities. It's no wonder infrastructure is falling apart. Municipalities have no further recourse than to change the mill rate or slap on user fees.

As for the traffic ticket... you were wrong, got caught, suck it up. Can't believe that you really think it is the government's responsibility to notify you. If they sent you reminder notices, you would probably be on this board complaining about Big Brother harassing you. You screwed up and got caught. Next time obey the rules of the road.

Between a rock and a hard place
I was pulled ovr September 30, 2007 for not wearing my seatbelt. I showed the that it couldn't fit.. I was too big at the time. he tells me to get a doctors note. No I've lost over 50lbs since then and it fits. No doctor would give me a note now. My court date is set for June 18 2008. I will show them my weight loss record and hope thats good enough. Also my license was expired at the time, as of September 18, 2007, but I held my breath and he said nothing about it and let me go on my way.

Thanks for the whoopla - if it wasn't - I might not have noticed the cops waiting for peeps to roll through the stop sign this morning, as I was about to.

Strange thing though: I went by them once and on my way back not even a few minutes later I forgot they were there [short term memory loss probably due to listening to Mary Jane too much]. As I was about to roll through again - there was a female cop [tall slim blond] standing at the stop sign, which was also a bus stop, leaning on the fence, trying to be inconspicuous in a cop uniform – or maybe she was working :D


I always plead NOT GUILTY. I never suck it up to anybody. So that's what I recommend. Worse thing can happen is you pay the fines already on your ticket but at least a year later.

They sell seat belt extenders to make the seat belt longer, not sure who sells them but I have seen them.

They didn't wait for me to come back...... they never left the corner, they sit there for hours I guess, I watched for a while, some got stopped, some didn't. depends where he was looking, at the traffic or her

To be honest here its not even the tickets that worry me.. there are some that seem offended that I even mention it at all, the STOP WRONG PLACE ticket I would not argue with, I've never even heard of that one, I really don't know where the tires were and really don't think I came to a full stop anyways, as for running over a three year old, its not that way...I wasn't speeding, there was no one around, I had full view, if you have a three year old at the curb who darts out into traffic then I would say where were you..you let your three year old run around the street??? or was that a mistake like my licence problem, I have run it through my head a hundred times and just cannot remember recieving my notice, O.K. O.k. I know, thats not an excuse although without notices I would bet at least 50% of the people would forget,, its my insurance that worries me the most, not sure if it will be affected.. BUT.. lets say an extra 150$ a month, I have 2 vehicules x 24 months? not sure how it works, =3600+the 325 fine=$3925 for a mistake....................suck it up??? yaaah O.K..

And NO, I think its on the back, ever look?? me neither...

Since you did come to a stop they weren't going to ticket you for failure to come to a complete stop (even though you wouldn't likely have stopped had you not seen the cops) so they nailed you with stopping too far into the intersection.

136. (1) Every driver or street car operator approaching a stop sign at an intersection,

(a) shall stop his or her vehicle or street car at a marked stop line or, if none, then immediately before entering the nearest crosswalk or, if none, then immediately before entering the intersection;

Yup it is and I do, it's this April and I marked it on the calendar before I got the notice just to make sure I do remember.

Unlike most of you I have sympathy for this guy. Our driver's license expires every 5 years in Ontario. Be honest, how many of us know when ours expires. For one the expiry date is put on the back so its not plain and visible when we pull our license out. If the Ministry forgot to send the notice (sorry dude if they sent the notice to a different address that is your responsibility to update when you move) then I think the guy has a valid point here. A $300+ fine driving with an expired license is ridiculous. I got caught not having an up to date insurance tag and was fined $60 but had that reduced to zero in court. Hopefully you will have the same fortune.

Thanks K.D., I was never looking for sympathy, only telling my story, I realise it is my own fault, notice or no notice, still my problem, I have been told to man up, suck it up, etc, by many who are perfect and would never do the same, all my best to those few, I was across the steet today talking to a ex metro cop, friend of mine, he told me the York cops are assholes, no breaks, BUT, I have learned and believe it when I say....IT WILL NEVER HAPPEN AGAIN........
hope my insurance is not affected also... my agent is a old friend also so tomorro I will phone and ask, my ex cop friend told me NEVER, NEVER , plead guilty, fight it, for sure it will be reduced even if found guilty........

If cops accept the excuse "sorry, it was a mistake" from you, then they'd have to accept the same excuse from everybody else. And then nobody would ever get a ticket. And so nobody would bother following the rules.
