The players get another break…shouldn’t matter much, the player Tyler already testified he saw Dubé slap her hard...the Dube people are saying it wasn't a slap it was light caressing as in foreplay.

in reading this I guess there is still a way the Crown can get it in.

Oh man, Howden's testimony is taking a turn:

Cunningham is questioning Howden about a July 3, 2018, interview he did with Hockey Canada investigator Danielle Robitaille, two weeks after the alleged assault in the London, Ont., hotel room.

Cunningham is asking him to read out excerpts of the interview.

In one excerpt, Howden said: “She would start to get dressed … she was way too sober for this.”
Another excerpt includes Howden talking about the woman crying, in which he says he “didn’t see her crying, but I just heard, it sounded like crying.”
So, either these guys lied in 2018 to hockey canada, just after it happened, or they're lying now when criminal charges are on the line.

So, either these guys lied in 2018 to hockey canada, just after it happened, or they're lying now when criminal charges are on the line.
Well the Crown did something to deal with Howden's "memory lost", she read parts of his statement back to him and he replied that he doesn't remember them but if he said it at the time he must have meant them to be true...so she got some pretty damaging information to the players submitted to the court.

I didn't like Howden and his "memory loss" in attempts to derail the case, but I do kind of feel bad for him. He didn't want any part of this in the hotel room. He got out of there quickly, apparently not quick enough though, and he doesn't need this, the statement he's had to make to Hockey Canada, the police. He goes on the stand and thinks he's doing the players a solid and then he just takes more heat for that gets accused of faking it/lying, starts crying. I think he wishes that he wasn't involved in any of this.

I don't see anything there in his testimony that is overly damaging to the defense. Even if E.M. was crying it was after the encounter, probably when she sobered up.
I've said this all along I don't like what these guys did, particularly McLeod who blasted a text out inviting guys to a threesome or more. Even if it was at E.M.'s suggestion that was a stupid move. But it doesn't rise to the level of sexual assault when E.M. was a willing participant.

I've said this all along I don't like what these guys did, particularly McLeod who blasted a text out inviting guys to a threesome or more. Even if it was at E.M.'s suggestion that was a stupid move. But it doesn't rise to the level of sexual assault when E.M. was a willing participant.

Her leaving the bathroom naked and lying down saying "Isn't anybody gonna fuck me?" is NOT consent for anybody to do anything...it is NOT an open invitation for the players to do what they want.

Howden's statements in 2018 were made in the Hockey Canada independent investigation. If the jury had not been dismissed, Howden would likely not have been called as a prosecution witness.

Hockey Canada asked questions to which defense counsel would have objected, (had those questions been asked by the Crown), and the Judge would have sustained the objection. The Judge allows those questions in court now because there is no jury, and thus no change of a verdict being reached through emotional response to testimony, as opposed to from evidence.

So if I read this correctly what this means is the prosecution was given added leverage by the jury dismissal. Interesting.

And E.M. said "It was all consensual" in a cell phone video. That is evidence, not speculation. Plus, once again, an ass slap, even a hard one, is not sexual assault. It might be grounds for an assault charge, but not a sexual assault charge. The five accused were not charged with assault, so therefore the ass slap is essentially irrelevant.

As for Cam Foote and his 'party trick', I doubt that anyone has ever been convicted of sexual assault for touching someone's facial cheek with their penis.

You can't compare a hook-up with a SW and the London Hotel Room action as the same thing...
-the victim wasn't a SW
-the victim didn't consent for a 3-way as McLeod inviting the team into for
-implicit consent does not apply to what Dube did, he wasn't into doggy, he just came in and did it

Her coming out of the bathroom naked saying "Who wants to fuck me" is NOT consent, it is not an invitation for anybody to do anything!

The "slap" and the legal definition of sexual assault is why the Crown is making a big deal of it, why Dube's people defended it as light caressing as foreplay, and why Dube called at least two players and told them not say what he did...
