The players get another break…shouldn’t matter much, the player Tyler already testified he saw Dubé slap her hard...the Dube people are saying it wasn't a slap it was light caressing as in foreplay.

So, either these guys lied in 2018 to hockey canada, just after it happened, or they're lying now when criminal charges are on the line.
Well the Crown did something to deal with Howden's "memory lost", she read parts of his statement back to him and he replied that he doesn't remember them but if he said it at the time he must have meant them to be true...so she got some pretty damaging information to the players submitted to the court.
I didn't like Howden and his "memory loss" in attempts to derail the case, but I do kind of feel bad for him. He didn't want any part of this in the hotel room. He got out of there quickly, apparently not quick enough though, and he doesn't need this, the statement he's had to make to Hockey Canada, the police. He goes on the stand and thinks he's doing the players a solid and then he just takes more heat for that gets accused of faking it/lying, starts crying. I think he wishes that he wasn't involved in any of this.

I don't see anything there in his testimony that is overly damaging to the defense. Even if E.M. was crying it was after the encounter, probably when she sobered up.
I've said this all along I don't like what these guys did, particularly McLeod who blasted a text out inviting guys to a threesome or more. Even if it was at E.M.'s suggestion that was a stupid move. But it doesn't rise to the level of sexual assault when E.M. was a willing participant.

So if I read this correctly what this means is the prosecution was given added leverage by the jury dismissal. Interesting.

And E.M. said "It was all consensual" in a cell phone video. That is evidence, not speculation. Plus, once again, an ass slap, even a hard one, is not sexual assault. It might be grounds for an assault charge, but not a sexual assault charge. The five accused were not charged with assault, so therefore the ass slap is essentially irrelevant.
As for Cam Foote and his 'party trick', I doubt that anyone has ever been convicted of sexual assault for touching someone's facial cheek with their penis.
You can't compare a hook-up with a SW and the London Hotel Room action as the same thing...

The "slap" and the legal definition of sexual assault is why the Crown is making a big deal of it, why Dube's people defended it as light caressing as foreplay, and why Dube called at least two players and told them not say what he did...
