I didn't like Howden and his "memory loss" in attempts to derail the case, but I do kind of feel bad for him. He didn't want any part of this in the hotel room. He got out of there quickly, apparently not quick enough though, and he doesn't need this, the statement he's had to make to Hockey Canada, the police. He goes on the stand and thinks he's doing the players a solid and then he just takes more heat for that gets accused of faking it/lying, starts crying. I think he wishes that he wasn't involved in any of this.

I've said this all along I don't like what these guys did, particularly McLeod who blasted a text out inviting guys to a threesome or more. Even if it was at E.M.'s suggestion that was a stupid move. But it doesn't rise to the level of sexual assault when E.M. was a willing participant.
So if I read this correctly what this means is the prosecution was given added leverage by the jury dismissal. Interesting.From post #311:

Howden's statements in 2018 were made in the Hockey Canada independent investigation. If the jury had not been dismissed, Howden would likely not have been called as a prosecution witness.
Hockey Canada asked questions to which defense counsel would have objected, (had those questions been asked by the Crown), and the Judge would have sustained the objection. The Judge allows those questions in court now because there is no jury, and thus no change of a verdict being reached through emotional response to testimony, as opposed to from evidence.
